Penalty on Builder: A builder’s violation of his promise proved so costly that a fine of Rs 7.5 lakh was imposed on him. This case is from Delhi where two builders, while selling flats to the buyers, had promised that they would install a lift in the building. But this did not happen even after 10 years, due to which people got angry and filed a complaint in the consumer court.

What is the whole matter?
Actually, two flat owners had complained to the Commission that they had purchased the flats in the year 2013 and 2014. At that time the builders had assured them that the lift would be installed within a month of registration. The cost of lift was also included in the price of the flat, but even after many years this promise was not fulfilled. Due to which the angry flat owners complained to the builder.

Also read: ITR Filing: If there is any mistake in ITR, there will be a penalty of Rs 25000, if there is delay, you will have to pay Rs 5000, understand the rules.

sent a legal notice
After waiting for this matter for almost four years, the flat owners sent a legal notice in the year 2018. After this, an agreement was reached between the two parties on 19 August 2018. According to the agreement, the builders had to install the lift by March 31, 2019. If they did not do so, they had to pay Rs 6 lakh to the flat owners.

Commission’s decision
After the complaint of the flat owners, the Commission found that the builders neither installed the lift within the stipulated time nor paid Rs 6 lakh. It was also clearly written in the documents that the buyers would have the right to use the lift and other shared facilities of the building. Therefore, it was the responsibility of the builders to provide lifts. The commission ordered builders to pay Rs 6 lakh to flat owners, Rs 1 lakh for mental distress and harassment and Rs 50,000 as litigation expenses.

Also read: Inflation News: From AC to car, from potato to LPG, these goods became cheaper, know what made them expensive?

Not only this, the Commission also said that builders are legally responsible for providing the promised facilities and scheduled facilities to the buyers on time. If they do not do so, they may have to pay compensation.

What can consumers do?
If something like this happens to you or someone close to you, you can take help of the law. The court will help you in such cases and will also get you compensation.

In today’s time, alimony has become a big legal issue in cases of divorce or separation of husband and wife. Often the husband has to bear the responsibility of maintaining the wife and children. One such surprising case has come to light, in which a man once earned an annual salary of around Rs 6 crore, but now after the court order, he will have to pay around Rs 5 crore to his wife.

This matter is related to Singapore. This person, a resident of Canada, was working as a senior executive in the Singapore office of a multinational company. In 2013, he shifted to Singapore with his wife and four children. Its annual income in the year 2023 was more than S$860,000, which is approximately Rs 6.13 crore in Indian currency.

Husband left wife and started living with another woman

According to media reports, in August 2023, the man left his wife and children and started living with another woman. After this, he proposed to give alimony to his wife of S$20,000 every month i.e. about Rs 15.5 lakh. This also included house rent, children’s school fees and transportation expenses. Later this amount was reduced to S$11,000 i.e. about Rs 7.7 lakh.

Wife moved court

Describing this arrangement as inadequate, the wife filed a maintenance application in the court on 2 October 2023 under the Women’s Charter Act of Singapore. The woman said that her husband did not provide her adequate financial support after leaving the family.

Husband left his job and returned to the country

A few days after the maintenance application was filed in the court, on October 9, 2023, the husband resigned from his job. In January 2024, he left Singapore and went back to Canada. During this time, the court also issued an arrest warrant against him, which was later canceled when he attended the virtual hearing.

Divorce petition and husband’s argument

In April 2024, the wife also filed a divorce petition. The husband claimed in the court that his image was tarnished because of his wife, due to which he had to leave the job. However, the court did not accept this argument.

Big decision of the court, order to give 5 crores

The court, while giving its verdict after the hearing, said that the total maintenance amount from September 2023 to September 2025 comes to S$788,300. In Indian currency this amount is approximately Rs 5 crore. The court also accepted that the husband deliberately tried to avoid maintenance by leaving his job. However, the husband had already paid S$154,383 i.e. about Rs 1 crore. Even now he will have to pay approximately Rs 4 crore to his wife.

Appeal in higher court, relief for now

The husband has filed an appeal in the higher court against this decision. The order for lump sum payment has been put on hold until the decision on the appeal is made. That means at present he will not have to pay the money immediately as per the order of the lower court.
