<p style="text-align: justify;">There is news of great relief for the parents of Delhi. Parents who have been struggling with uncontrolled fee hike in private schools for years are now going to get legal protection. The Delhi government has formally implemented a new law made with the aim of controlling the fee system of private schools, due to which the process of fixing fees will no longer be arbitrary but will be within the limits of the rules.</p>
<h3 style="text-align: justify;">Law implemented after LG&#8217;s approval</h3>
<p style="text-align: justify;">Nearly four months after it was passed by the Delhi Assembly, the Delhi School Education (Transparency in Fee Determination and Regulation) Act, 2025 has received the approval of Lieutenant Governor VK Saxena. With this, this law has become effective in the entire capital region and the responsibility of its implementation has been handed over to the Education Department.</p>
<h3 style="text-align: justify;">Government investigation will be done before deciding the fees</h3>
<p style="text-align: justify;">Now private schools will have to disclose their complete financial position before increasing fees. The Education Department will examine the expenditure, income and fee proposals of the schools and they will be approved only if they are in accordance with the rules. Every process related to fees, from investigation to monitoring, will now run under the fixed structure.</p>
<h3 style="text-align: justify;">Education is not business- Ashish Sood</h3>
<p style="text-align: justify;">Describing this law as a major reform in the education sector, Education Minister Ashish Sood said that this issue was pending for decades, but the present government has taken concrete steps in a short time. He clearly said, &#8220;Education cannot be made a source of profit and the government will ensure that no child has to suffer due to financial reasons.&#8221;</p>
<h3 style="text-align: justify;">Immediate action on parents&#8217; complaints</h3>
<p style="text-align: justify;">The government has also clarified that if any school collects fees bypassing the rules, parents can complain directly. Provision has been made for prompt action on such complaints, so that parents do not have to make repeated trips to schools.</p>
<h3 style="text-align: justify;">Complete ban on capitation fees</h3>
<p style="text-align: justify;">Under the new law, capitation fees or any kind of hidden collection has been completely banned. Schools will now be able to charge fees only for those facilities which the student actually avails. All user-based charges will be determined on the principle of no-profit, no-loss.</p>
<h3 style="text-align: justify;">Schools will have to maintain separate financial records</h3>
<p style="text-align: justify;">Private schools will now have to maintain separate accounts for each item and also prepare complete records of their assets. The money taken from parents cannot be transferred directly to any trust or society. If there is excess amount left at the end of the year, it will either have to be returned or adjusted in the next fee.</p>
<h3 style="text-align: justify;">A committee will be formed in every school to decide fees.</h3>
<p style="text-align: justify;">According to the law, the same rules will apply to all private schools, whether they fall in the minority category or are built on government land or not. A fee regulation committee will be formed in every school, which will include the school management, a representative of the education department and five parents selected through lottery. This committee can reduce or approve the fees, but will not have the right to increase them. The fee once decided cannot be changed for three years.</p>
<h3 style="text-align: justify;">Trying to regain the trust of parents!</h3>
<p style="text-align: justify;">The government believes that this law will increase the accountability of schools and strengthen parents&#8217; trust in the education system. This is being considered an important step towards resolving the long standing problem of dissatisfaction regarding fees.</p>

<p style="text-align: justify;">There is news of relief for lakhs of parents of Delhi, now the private schools of the capital will not be able to increase the fees arbitrarily. The Delhi government has implemented the Delhi Education Bill (Fixing and Regulation of Fees) Act 2025 to control the increase in fees of private schools. The notification of this law has been issued by Lieutenant Governor VK Saxena in the Delhi budget.</p>
<p style="text-align: justify;"><strong>Why was the new law necessary?</strong></p>
<p style="text-align: justify;">Parents were worried about the increase in fees of private schools in Delhi for a long time. Many schools used to increase the fees every year without any concrete reason. Due to this, the financial burden on the families of middle and low income group was increasing. Keeping this problem in mind, the government has made this new law.</p>
<p style="text-align: justify;"><strong>Consent of 15 percent parents is required for complaint</strong></p>
<p style="text-align: justify;">Under the new law, to file a complaint against the fee increase, the consent of at least 15 percent of the parents will be required, that is, if the fee increase of any school seems wrong, then the parents will be able to come together and complain formally. The government says that this will stop unnecessary complaints and real matters can be focused on.</p>
<p style="text-align: justify;"><strong>More than 1700 private schools will come under the ambit</strong></p>
<p style="text-align: justify;">More than 1700 private schools of Delhi have been included under this Act, which means that now almost all big and small private schools will have to follow the rules related to fees and will not be able to take decisions arbitrarily.</p>
<p style="text-align: justify;"><strong>Three level system for fee monitoring</strong></p>
<ul>
<li style="text-align: justify;">The government has created a three-tier system to monitor fees.</li>
<li style="text-align: justify;">There will be a fee regulation committee in the school at the first level.</li>
<li style="text-align: justify;">At the second level, there will be a district level fee appeal committee.</li>
<li style="text-align: justify;">At the third and final level, there will be an amendment committee, which will be able to make changes in the decisions if necessary.</li>
</ul>
<p style="text-align: justify;"><strong>Statement of Education Minister Ashish Sood</strong></p>
<p style="text-align: justify;">Delhi Government&#8217;s Education Minister Ashish Sood has described this law as a historic step. He said that the Education Department will now start implementing all the rules and procedures mentioned in the law, which includes scrutiny, approval, reporting and monitoring of school fee proposals.</p>
<p style="text-align: justify;"><strong>Education is not a business, it is a right</strong></p>
<p style="text-align: justify;">Ashish Sood said that education is not a business but the right of every child. The aim of the government is that every child of Delhi should get quality education with transparency, honesty and fairness.</p>
<p style="text-align: justify;"><strong>Government&#8217;s appeal to parents</strong></p>
<p style="text-align: justify;">The government has appealed to the parents and patrons to support this new law and cooperate in maintaining transparency. This will further strengthen public confidence in the education system. With the implementation of this law, parents will get relief from the recurring problems related to fees. Now they will be able to express their views without fear and their complaints will be heard.</p>
<p style="text-align: justify;"><strong>Accountability of schools will be fixed</strong></p>
<p style="text-align: justify;">Under the new law, schools will have to clearly disclose their fee structure, expenses and financial requirements; action can be taken against increasing fees without proper reason; this will ensure accountability of the schools.</p>

<p style="text-align: justify;"><strong>Delhi high court:</strong> Delhi High Court has given Lieutenant Governor V.K. Notice has been issued to Saxena. This notice has been issued on the petition of social worker and leader of Narmada Bachao Andolan, Medha Patkar, in which he sought permission to investigate a new witness in his defamation case filed in 2000.</p>
<p style="text-align: justify;"><strong>Trial court turned down demand for new witness, challenge in Delhi High Court</strong></p>
<p style="text-align: justify;">The case began when Medha Patkar accused LG Saxena that he had published an advertisement against him allegedly defamation against him while being the head of an NGO in Gujarat. The trial court on March 18 rejected the demand for a new witness of Medhapatkar, saying that the case has been pending for 24 years and already all the witnesses have been completed. The court also said that if such new witnesses are added to the cases, then the lawsuits will never end. Patkar challenged this decision in the High Court, after which the High Court issued a notice to Delhi Lieutenant Governor VK Saxena and sought a reply.</p>
<p style="text-align: justify;"><strong>Lt. Governor&#8217;s lawyer alleged -Conspiracy to delay the process</strong></p>
<p style="text-align: justify;">Medha Patkar filed an application in Saket Court on February 17 seeking permission to check Nandita Narayan as an additional witness. He said that this witness can highlight important facts related to the case. However, Saxena&#8217;s lawyer opposed this, saying that this petition has been filed only after 24 years to prolong the trial process, which is like obstructing justice.</p>
<p style="text-align: justify;"><strong>Legal battle continues since 2000</strong></p>
<p style="text-align: justify;">This legal battle started in 2000 when Patkar filed a defamation case against Saxena. At that time Saxena was the head of Ahmedabad -based NGO Council for Civil Liberty. In response, in 2001, LGV Saxena also filed two defamation cases against Medha Patkar. The first case was for making alleged derogatory remarks against him on a television channel and the second case was for issuing a defamatory press statement.</p>
<p style="text-align: justify;"><strong>Next hearing in Delhi High Court on 20 May</strong></p>
<p style="text-align: justify;">The Delhi High Court has not yet stayed the trial court proceedings and the next hearing has been fixed on May 20. Now it has to be seen what decision the High Court gives further in this matter.</p>
