Many Muslim religious leaders have reacted sharply to Baba Ramdev’s statement. The Supreme Court will hear the petition against the action on madrasas in Uttarakhand. The state government is shutting down madrasas running without any recognition. Jamiat Ulema -e -Hind has filed an application against this. The Supreme Court has associated it with a petition already pending about madrasas across the country.

A bench of Supreme Court Justice MM Sundresh and Justice Rajesh Bindal said that there is nothing wrong in asking for information about the quality of education being given in madrasas, status of the right to education law or their funding. If the petitioner has any problem, he can go to the High Court. Senior advocate Kapil Sibal, appearing for Jamiat, protested against this and cited an order of the Supreme Court which came last year.

The order that Kapil Sibal spoke about, was given to the petition of Jamiat Ulema -e -Hind by a bench headed by the then Chief Justice DY Chandrachud on 21 October 2024. In that order, the court had banned the action to transfer all students of unrecognized madrasas of UP to schools. The court also stayed the state government’s decision to remove non -Muslim students from government grants madrasas. The basis of this action of the UP government was a instruction from the National Commission for Protection of Child Rights (NCPCR) to all the states in June 2024. The court had also stayed that directive.

Kapil Sibal told the judges that a notice was sent to all the states in this case. Further hearing has to be held on this. Now it will not be right to ask for Uttarakhand to go to the High Court. Accepting this argument of Kapil Sibal, the court said that he will listen to this application with the main case.
