According to the report of Live Law, the petition has challenged the order of Indore Bench of Madhya Pradesh High Court, which said that allowing VIP entry into the sanctum sanctorum of Mahakeshwar Temple in Ujjain depends on the discretion of the temple administration and district authorities. Vishnu Shankar Jain, lawyer of petitioner Darpan Singh Awasthi, said that he is talking about violation of Article 14 of the Constitution here. Whether a person is allowed to enter the sanctum sanctorum or not should depend on the guidelines.

He said that the High Court cannot discriminate between citizens. He cannot discriminate like this on the basis of VIP. Advocate Vishnu Shankar Jain said that there should be the same policy for everyone to enter the sanctum sanctorum. Vishnu Shankar Jain said that if a person enters the sanctum sanctorum, then he is allowed on the recommendation of the collector. In this way, if any other devotee goes to Mahakal, he also has the right to go to the sanctum sanctorum and offer water to the Lord.

Advocate Vishnu Shankar Jain said that his only point is that either everyone should have the right to go to the sanctum sanctorum or no one should. The rules should be the same for everyone. After hearing the arguments, CJI Surya Kant said that it is not the job of the court to decide whether permission to enter the sanctum sanctorum should be given or not. If the court starts deciding who will go to the sanctum sanctorum and who will not, then it will be too much for him. The CJI said that if the court accepts that Article 14 should be implemented in the sanctum sanctorum, then tomorrow people will start claiming other rights like Article 19 as well.

The CJI said, ‘First you will say that I also have the right to enter the sanctum sanctorum because so and so person entered, then you will say that I have the right to chant mantras there because I have the freedom of speech, then in this way all the fundamental rights will be claimed inside the sanctum sanctorum. CJI Surya Kant said that these people who are filing the petition are also not devotees. They want something else.
