If the society has given the status of God to the parents, then should the same God be forced to live a life of insult in his own house? Think, the parents who raised their children by raising them, if the same children start harassing them mentally or physically in old age? The law in India is now with such elderly parents. A question that has been a topic of discussion in social media and society is whether if children abuse them, parents can evict them from their property? The answer is yes, you can do it at all. And this right has been given to him by the law of India.

Let us tell you that in India, people who are 60 years or above are considered senior citizens. So at the same time, people aged 80 years or older are considered very senior citizens. The Maintenance and Welfare of Parents and Senior Citizen Act 2007 has been enacted regarding senior citizens in India. Apart from this, the government has also formed the National Policy for Older Person which protects the rights of the elderly in India. In both these policy, all the requirements of senior citizens are met. These include financial security, medical security, expenses for maintenance and all security.

Legal rights get to snatch property

A very important law has been implemented in India to legally secure the care of the elderly, which is called “Maintenance and Welfare of Parents and Senior Citizens Act, 2007.” The purpose of this law is that no elderly person feels lonely and destitute at the last stage of his life. If an elderly person is not in a position to take care of himself, whether it is financially weak or physically helpless, then it becomes the responsibility of their family members. If the heir denies all these responsibilities, then the court can take away the right to property from them.

Also read: Will the house whose house is already installed, will not be able to run below 20 degrees

The court can give a decision under this law

If an elderly citizen, who has given the property earned by his hard work to his children or heirs on the belief that they will take care of them, but later the same children or successors are far away to serve them, they start ignoring them or starting to ignore them, then the elderly are no longer helpless. They have the legal way to get their given property back.

According to the Maintenance and Welfare of Parents and Senior Citizens Act 2007, if an elderly person feels that the property given by keeping it in a deception or on the condition of service is now causing insult or ignoring, then he can change this situation. For this, they have to file a petition not in any big court, but in the Senior Citizen Tribunal i.e. Special Tribunal. After this, the court can order to return the property.
