On an important question related to Muslim will, the Supreme Court has issued a notice to the Central Government. Muslim Personal Law violates the fundamental right of religious freedom: Petition

The petition of Kerala, who is advocating in Abu Dhabi, stated that the Holy Quran allows Muslims for a will, but limits the Muslim personal law applicable in India. This provision of personal law is not according to the Quran. In such a situation, it violates the fundamental right to religious freedom found under Article 25 of the Constitution. It also violates Article 14, 15 (right to equality), 21 (right to life) and 300A (right to property).

Father cannot give equal property to sons to daughters: petition

The petitioner has said that in modern times boys and girls are being seen with equality, but if a Muslim father wants to give equal property to his sons and daughters, he cannot do so. Muslim personal law prevents him from doing so. At present, one -third of the property has the right to the will. Supreme Court Justice P.S. Narasimha and A. S. Chandurkar’s bench accepted the petition for hearing after a short debate. The court said that it will hear this petition with a petition already pending on this subject.

Protest against waqf act: Protests are being seen in many states regarding the Waqf Act passed by Parliament. Also, hearing is going on in the Supreme Court regarding this. The latest development organized a General Assembly by the All India Muslim Personal Law Board on the night of Sunday (April 19, 2025) in Hyderabad, which received the support of AIMIM. Constant protests were announced in this General Assembly.

During this time it has also been announced that on April 30, 2025, blackout protests will be held, in which all the lights of the houses will be closed at 9 pm. Bachao Bachao, Bachao public meeting held at Darussalam, the headquarters of AIMIM in Hyderabad, was announced to protest in the Constitution. Members of several parties including Congress, Bharat Rashtra Samithi (BRS), YSR Congress Party and Dravid Munnetra Kazhagam (DMK) attended this meeting.

‘Movement against forces ending Muslims’

Hyderabad MP and AIMIM chief Asaduddin Owaisi said that this movement is against the forces that want to end us, but we will continue to move forward. He said, “These forces trying to share and break us will collapse. We will not bow our heads. When I torn the law in Parliament, I also did this from all the brothers and sisters of other religions who would be affected by similar cruel laws.”

Round-table meeting will be held on May 18

In this General Assembly, it was also decided to organize a round-table meeting at the city level on 18 May and later to hold similar meetings in all the districts. AIMPLB said, “Local minority leaders and secular representatives should be invited to participate in these meetings.” On May 22, a public meeting of women will be held at Idgah Bilali Hockey Ground in Hyderabad.

On May 25, a protest will be held in Hyderabad from 2 pm to 2.30 pm and protest will be held on 1 June. The AIMPLB leadership announced on Sunday, “Public meetings will be held in the districts of Andhra and Telangana in consultation with local leadership.”

‘How dangerous is this law’

AIMPLB President Maulana Khalid Saifullah Rahmani said, “We are confident in the courts that this law will be banned. There are people who have encroached on Waqf property and this law has made it impossible to regain Waqf property.” He said that this law will make Muslims only visitor on their own property. Rahmani said, “Any mosque from Mecca Masjid can be considered a non-confident property. You can come as a tourist to see the property. How dangerous this law is?”

‘Dawoodi Bohra Community not supporting law’

Owaisi said that the Dawoodi Bohra community is not supporting the law, while the BJP is claiming that this community is supporting. Owaisi said, “The community had said in front of the Joint Parliamentary Committee (JPC) that they would not support the Waqf Act.” He said that BJP leaders, including Prime Minister Narendra Modi, have misled the community and have presented incorrectly.

Asaduddin Owaisi Attack on PM: Asaduddin Owaisi has called the Waqf Amendment Bill an attack on the land and identity of Muslims. Some kind of government occupation is against the constitution and religious freedom.

Hearted response to BJP MP Nishikant Dubey
The AIMIM chief called upon his supporters to unite and launch the movement in support of the decision of the Muslim Personal Law Board. He said that just as farmers fought a long battle against agricultural laws, similarly Muslims will also have to raise their voice against this law. Owaisi also reacted sharply to the statement of BJP MP Nishikant Dubey, in which he had commented on the Supreme Court. He said, “BJP leaders are now threatening the Supreme Court. It is clear that the government does not accept the constitution nor the judiciary.”

Modi government is doing politics of hate in the country- AIMIM
The AIMIM chief also said that the Modi government is doing politics of hatred and partition in the country. He said, “The beauty of India is its brotherhood, not Modi. If this Waqf Amendment Act is implemented, it will harm India’s common heritage.”

Bhopal protest against waqf act: In Madhya Pradesh’s capital Bhopal on Thursday, the Muslim society unitedly demonstrated in protest against the Waqf Amendment Bill (Waqf Act). This strike was organized under the leadership of All India Muslim Personal Law Board, in which a large number of people participated.

The protesters, wearing black clothes and lodged a peaceful protest in front of the Central Library from 2 pm to 4 pm. During this time he neither raised any political flag nor supported any particular party.

Opposition to law, hope of justice
Congress MLA Arif Masood, who is leading the demonstration, made serious allegations against the government and said that this bill is not an attempt to protect Waqf properties, but to grab them. He said, “This law does not protect Waqf, but has been brought with the intention of freeing the assets of the government. This will not benefit the Waqf Board. We will not accept it under any circumstances.”

Arif Masood also clarified that the demonstration will not be limited to the roads only, but will be taken to the Supreme Court. He expressed confidence that the judiciary would intervene in the matter and provide justice to the Muslim society.

BJP’s response: ‘selfish -based movement’
On the other hand, BJP leaders have described this protest as ‘selfish based’. He says that this amendment has been brought with the aim of ensuring correct use of Waqf properties and rein in corruption. He claimed that this would really benefit poor Muslims, not some selected people who control Waqf properties.

Preparation for nationwide movement
This demonstration of Bhopal is part of the “Waqf Bachao Campaign”, which has been started by the All India Muslim Personal Law Board. This campaign will be run across the country by 7 July. Waqf amendment bill 2024: The All India Muslim Personal Law Board (AIMPLB) has appealed to Muslims across the country to tie a black band on the last Friday of Ramadan in protest against the Waqf Amendment Bill 2024.

Sharing a letter on the social media platform ‘X’, AIMPLB said, ‘Strict protests by Muslims at Jantar Mantar in Delhi and Patna have created restlessness in at least BJP allies. Now on March 29, there is going to be a massive protest in Vijayawada.

AIMPLB wrote, ‘The Waqf Amendment Bill 2025 is a conspiracy that aims to deprive Muslims of their mosques, Idgahs, Madrasas, Dargahs, Khankahs and cemeteries. Efforts are being made to snatch all this from us. Therefore, it is the responsibility of every Muslim of the country to strongly oppose this bill. The All India Muslim Personal Law Board appeals to all Muslims to tie a black bandage in the hands as a silent and peaceful expression of protest while coming to the mosque on Jumatul Vida.

Proposal in Tamil Nadu Assembly against Waqf Amendment Bill
Meanwhile, a resolution has been passed against the Waqf (Amendment) Bill 2024 in the Tamil Nadu Assembly. This proposal was introduced by CM MK Stalin himself. In the Assembly, CM Stalin said that the Waqf Amendment Bill is against Muslims. This bill will destroy the rights of Muslims. The central government never thought about the welfare of Muslims and their rights. Therefore, we are passing a resolution against it.

What is the Waqf Amendment Bill?

Jagdambika Pal also said that the demonstrations in Jantar Mantar and Patna will not make any difference to the process of this law. If any kind of unconventionalism is found in the bill, then people can move to the court. He informed that the Joint Parliament Committee has submitted its report to the government, which is now for approval in the cabinet. After this, the bill will be presented in Parliament.
