The National Medical Commission (NMC), the body that controls medical education in the country, is under question. Amicus Curiae and senior advocate Maninder Singh, appointed by the Supreme Court, in their report have expressed serious concern over the posts lying vacant for a long time, administrative delays, lack of transparency and alleged irregularities in NMC.

According to the report submitted to the Supreme Court, there is continuous delay in approval of medical colleges, renewal of seats, inspection, disposal of appeals and counseling process. Medical students are suffering the most loss due to this. The report states that despite claims of improvement over the years, the expected change in the situation has not taken place and every year the admission process is dragging on much beyond the scheduled time.

According to reports, admissions to postgraduate (PG) medical courses for the 2025-26 session will continue till February 2026, while undergraduate (UG) admissions will continue till December 2025. In many cases, the process of approval of medical colleges and renewal of seats continued till after the start of the academic session. This created a situation of uncertainty for both students and colleges.

Big question regarding staff

The biggest question raised in the report on the functioning of NMC is the shortage of staff. Even after six years of implementation of the NMC Act 2019, many important posts are lying vacant in the Commission and its autonomous boards. Regular appointments have not been made to key posts like various chairpersons, members and secretaries of the Commission. The report says that due to these posts remaining vacant, there is a delay in making rules, processing the applications of colleges, conducting inspections and taking decisions on appeals.

Concern expressed on this also

Amicus Curiae has also expressed concern over the lack of transparency. The report states that reports and regulatory decisions related to inspection of medical colleges are not being made public as before, although there is a provision in the law for their publication.

There have been allegations for a long time in the medical education sector that lack of transparency in processes like inspection, recognition and seat increase promotes corruption. Although the report has not directly accused any person or institution of corruption, the delay in regulatory processes and non-disclosure of information are raising questions about the credibility of the system.

The Supreme Court has also expressed concern several times over medical seats remaining vacant and the interests of students being affected. In recent decisions, the court has said that medical seats are a valuable resource of the country and cannot be left vacant due to administrative negligence.
