A hearing was held on Tuesday in the fraud case registered against Bollywood actress Shilpa Shetty and her husband Raj Kundra. During this, senior advocate Abad Ponda appeared on behalf of Raj Kundra and Shilpa Shetty and sought permission to go to London. It was said in the petition that Raj Kundra’s father’s health is very bad, hence he should be allowed to go abroad.

The court first asked about the nature of the crime in the case and the amount involved. The court was told that the matter is related to Rs 60 crore. On this, the court gave clear instructions that permission to travel abroad will be given only when the petitioner deposits the entire amount of Rs 60 crore in the court. Senior Advocate Ponda opposed this and said, ‘There is no law under which instructions can be given to deposit the entire amount.’

Full amount required to be deposited
The court said that it is not satisfied with the bona fide (intention) of the petitioners and there is no guarantee that they will return from abroad. Therefore it is necessary to deposit the full amount. After this, Ponda requested that instead of money, security or any other form of security should be accepted. On this, the court orally directed that the petitioner should submit a continuous bank guarantee of the nationalized bank to prove his intention.

Case adjourned for a week
Ponda argued that at least this amount should be kept ‘reasonable’, but the bench rejected it and said that the guarantee should be full and continuous at Rs 60 crore. After this, the government side told the court that the copy of this application has not yet been given to the EOW. The court got angry at this and ordered to list the case after three weeks. Later, Senior Advocate Ponda protested strongly and said that he will take instructions from his client on the bank guarantee, hence the date should be given before the Christmas break. Later the court adjourned the case for a week.

A new update has come in the case of actress Shilpa Shetty and her husband Raj Kundra in the case of fraud of Rs 60 crore from a businessman. The Economic Offenses Wing (EOW) has issued summons for questioning to four former employees working in the actress’s company. The statement of one of the four has been recorded.

EOW increased the pace of investigation
Summons have been sent to 4 employees working in Best Deal Private Limited. An Economic Offenses Wing official said that one employee of the company has appeared before the branch and his statement has also been recorded, while the appearance of three employees is yet to be done. All three of them will also be interrogated and their statements will be recorded. These four employees previously worked in the company.

Investigation team engaged in finding out the truth about 60 crore loan
The senior officer said that the team is investigating those aspects whether Raj Kundra’s company really had so many orders from customers, to fulfill which Raj Kundra had to take a loan of Rs 60 crore from the businessman and had shown the loan as an investment to save tax.

The team will also interrogate the product suppliers and advertising companies associated with the company. If anything suspicious comes to light during the interrogation, then Shilpa Shetty and Raj Kundra will be interrogated again.

Questions raised on company’s expenses
The Economic Offenses Wing asked the employee questions related to the company. The branch is trying to find out how salaries are paid to the company’s employees. Was part of the salary paid from the company’s earnings or was the salary money brought from somewhere else also? Was Rs 20 crore spent on furnishing offices?

The investigation branch will also interrogate the companies furnishing the offices. Earlier, Shilpa Shetty had sought permission from the court to go abroad, but the court had rejected the petition saying that first pay the fraudulent amount and then go where you want to go.

Bollywood actress Shilpa Shetty could not get permission to go abroad due to the Look Out Circular (LOC) issued against her. The actress had approached the Bombay High Court in this regard, so that she could be allowed to attend the YouTube event to be held in Los Angeles.

However, despite hearing twice, the court did not give permission at present. After this Shilpa Shetty canceled her foreign trip this month. Her lawyer told the court that the actress is now withdrawing her travel permission petition and will file a fresh application in December, when she plans to go abroad again.

EOW is investigating the fraud case

It is noteworthy that Shilpa Shetty and her husband Raj Kundra are being investigated by the EOW (Economic Offenses Wing) of Mumbai Police in the case of alleged fraud of Rs 60 crore. Under this investigation, LOC was issued against both of them.

Someone else’s signature is in the affidavit

During the hearing, complainant Deepak Kothari’s lawyers Dr Yusuf Iqbal Yusuf and Zain Shroff claimed in the court that the notarization process for the affidavit filed by Shilpa Shetty did not contain her own signature at one place. He also said that “there is a possibility that that signature might have been made by someone else.”

On this the court said, “If you want to take any action on this, you can do it as per law.” The complainant’s lawyer will soon file a petition for perjury (false testimony) and contempt of court (contempt of court) against this affidavit.

The court today passed a remark on the petition for cancellation of LOC filed by Bollywood actress Shilpa Shetty, saying that if you want to go abroad, then first become an approver. Actually, EOW of Mumbai Police has made Shilpa Shetty and her husband Raj Kundra an accused in the alleged fraud case of Rs 60 crore. LOC has been issued against him in this case.

EOW interrogated actress Shilpa Shetty in this case for about four and a half hours, while Raj Kundra’s statement was recorded for the second time. Officials said Kundra will be summoned again in the coming weeks in connection with the investigation.

There was a ban on foreign travel

Earlier, Bombay High Court had rejected the petition of Shilpa and Raj regarding foreign travel. The court ordered that if he wants to travel abroad to Los Angeles or any other place in America, then first he will have to deposit Rs 60 crores. Along with this, the court has also refused to stay the Lookout Circular (LOC) issued against him.
