The process of formation of the interim government under the leadership of former Chief Justice Sushila Karki in Nepal is caught in the deadlock. The leaders of Nepal are divided on whether Parliament should be dissolved before taking over Karki.

The formation of an interim administration under the leadership of Sushila Karki has been politically a widespread agreement, but the process got stuck in the middle during the tripartite talks between Nepal President Ramchandra Paudel, Army Chief Ashok Raj Sigdel and representatives of the Gen-G movement. Both Karki and Jane-G leader Sudan Gurung are adamant on the fact that the House of Representatives should be dissolved before taking oath.

What is the constitutional process to dissolve Parliament in Nepal?

According to the Constitution of Nepal, Parliament can be dissolved only after the Prime Minister’s recommendation and the approval of the President. This process in 2020 and 2021, the then Prime Minister K.K. P. Sharma was adopted twice under Oli’s rule, but in both the cases, the Supreme Court intervened and re -established the Parliament.

President Paudel is alerted by the recurrence of constitutional disputes and advocating a path that maintains institutional validity.

I will not take over PM without dissolving Parliament- Karki

A close friend of Nepal’s President Paudel said, “This entire process should be under the constitutional structure.” However, former Chief Justice Sushila Karki made it clear that she would not take over as an interim Prime Minister without dissolving Parliament.

Debate on the formation of interim government

Due to this difference, the formation of the interim government is currently hanging in the balance. The discussions are arguing whether President Paudel should dissolve Parliament just before Karki’s swearing in, or Karki should take the oath of Prime Minister first and after that the Parliament should be dissolved with his recommendation.
