A group of Republican Party MPs in America has introduced a bill in the Congress (US Parliament) to postpone the H-1B visa program for 3 years. Republican lawmakers argue that this program is being misused to replace American workers with foreign workers at low prices.

Congressman Eli Crane from Arizona introduced the ‘End H-1B Visa Abuse Act of 2026’, which has also been supported by seven other Republican lawmakers. The bill proposes reforms to the H-1B program, including reducing the annual limit from 65,000 to 25,000, setting the minimum salary at US$200,000 per year and not allowing H-1B visa holders to bring dependents to the US.

Which MPs signed
Congressmen Brian Babin, Brandon Gill, Wesley Hunt, Keith Self (all from Texas), Andy Ogles (from Tennessee), Paul Gosar (from Arizona) and Tom McClintock (from California) have signed on as original co-sponsors of the bill. American IT companies extensively use the H-1B visa program to hire foreign workers.

Will have to prove if American employee is not found
Indian professionals, including IT sector workers and physicians, are one of the largest groups of H-1B visa holders. The bill proposes changes to the H-1B program, including replacing the lottery system with a salary-based selection system. It has been made mandatory for employers to certify that they are unable to find any qualified American workers and have not made layoffs.

New rules for H-1B employees
This includes prohibiting H-1B workers from working more than one job and prohibiting them from being employed by third-party recruiting agencies. The bill also has provisions to ban federal agencies from sponsoring or employing nonimmigrant workers, eliminate OPT, and ensure that nonimmigrant visas remain temporary by preventing H-1B holders from becoming permanent residents. It is mandatory for non-immigrants to leave the United States before obtaining another nonimmigrant status while living in the United States.
