Former Chief Minister of Bihar and Rashtriya Janata Dal chief Lalu Prasad Yadav has approached the Delhi High Court challenging the charges framed by the lower court in the alleged IRCTC scam. This petition of Lalu Yadav has been listed for hearing before the bench of Justice Swarnkant Sharma in Delhi High Court on Monday.

In October last year, the Special Court of Delhi’s Rouse Avenue Court had framed charges of corruption and criminal conspiracy against Lalu Prasad Yadav and other accused. In this case, charges of criminal conspiracy and fraud have also been leveled against Lalu Yadav’s wife and former Bihar Chief Minister Rabri Devi, his son and Deputy Chief Minister Tejashwi Yadav and others.

While framing the charges, the court of Special Judge Vishal Gogane had said that when Lalu Prasad Yadav was the Railway Minister, he allegedly misused his position. According to the court, the eligibility conditions related to IRCTC’s hotel tender were manipulated so that favored companies could be benefited.

The court admitted that prima facie Lalu Yadav had knowledge of the conspiracy.

Rouse Avenue Court also admitted that prima facie Lalu Yadav was aware of this alleged conspiracy and he was actively involved in the decision process. This caused huge loss to the government treasury. This case started with the FIR registered by CBI in the year 2017.

According to CBI, between 2004 and 2009, when Lalu Yadav was the Railway Minister. Then a conspiracy was hatched to give the tender of IRCTC hotels located in Patna and Puri to certain private parties. In return, the accused were allegedly given bribe in the form of land and shares. After completion of the investigation, CBI filed a charge sheet against Lalu Prasad Yadav and 11 other accused. Now it will be decided in the Delhi High Court whether further action will continue on the allegations made by the lower court or not.

BJP spokesperson Neeraj Kumar said that charges have been framed against Lalu family. This is the victory of justice. This is indicative of the Modi government’s policy of zero tolerance towards corruption. On the other hand, JDU’s chief spokesperson Neeraj Kumar Singh said that it is natural for Lalu Prasad’s family to face charges of 420 and 120. Lalu Prasad gave jobs to the family members of his elder brother Mangru Rai and got land registered in Phulwari. This is a natural process.

It is alleged that these tenders were awarded to a private company named Sujatha Hotels in an irregular manner by misusing political and administrative influence. According to the CBI, in exchange for these tenders, valuable land in Patna was deposited with the Lalu family, which was allegedly transferred at non-market rates. This investigation started in the year 2017 when CBI had registered the FIR in the case and later prepared the chargesheet.

What are the chances of Tejashwi Yadav contesting the elections?

The answer is yes, because right now only charges have been framed against Tejashwi Yadav and not punishment. According to Indian law, he can contest elections unless he is sentenced by a court and if the sentence is two years or more. Section 8 of the Representation of the People Act, 1951, under which a person can be deprived of the right to be elected or contest elections only if he is convicted of a serious crime and sentenced to death.

Therefore, Tejashwi Yadav’s eligibility to contest the elections still remains. However, if the court finds them guilty and imposes the maximum sentence, they may be temporarily or permanently disqualified.

An important hearing was held on Tuesday in the Rouse Avenue Court in the job case in lieu of land. This case is related to several accused including RJD supremo and former Railway Minister Lalu Prasad Yadav. At the same time, Special CBI Judge Vishal Gog is hearing on framing of charges in this case. There are a total of 103 accused in this case, out of which four have died.

At the same time, the lawyer appearing on behalf of Rabri Devi in the court argued that there is no direct connection between the land and the job in this whole case, when the land was purchased and the money was given in lieu of it, then it can be said that the land was purchased at a cheaper rate, but it is wrong to call it land in exchange for jobs.

In the Rouse Avenue Court, Rabri Devi’s lawyer questioned the court that the CBI alleges that Rabri Devi benefited, but when the land deal was done through the deed, how can she be considered a beneficiary. If I am a buyer and am paying money, then how am I taking advantage. The benefit is only when the land is available as free or a favor.

The lawyer in the court argued that a major witness of the CBI told that he was asked to sell the land because Lalu Yadav wanted to build big land. Buying land is not a crime. The CBI says that the land was taken in exchange for the job, but they themselves have admitted that if the land was purchased then where is the question of bribe?

The investigating agency CBI alleges that Lalu Yadav, while being a railway minister between 2004 and 2009, got the Group D category recruitment in the West Central Railway Zone in Jabalpur in Madhya Pradesh and in lieu of the candidates and their families in the name of their families or colleagues. Currently, Rabri Devi will be heard on Wednesday in the Rouse Avenue Court.

Tej Pratap Yadav News: The elder son of RJD supremo Lalu Prasad Yadav and former Bihar minister Tej Pratap Yadav has been relieved from the Rouse Avenue Court. Traveling abroad has been allowed. Tej Pratap Yadav is an accused in the ‘Land’s Replacement Job’ scam and he is currently out on bail. The court has allowed him to go to Maldives from 17 May to 23 May with a condition. Special Judge Vishal Gogane said that going abroad for an accused cannot be stopped only on the basis that he is serious. It is his fundamental right to travel abroad, even if he is an accused. The process of justice should not be interrupted, this is paramount.

What is the matter?

The case is related to the alleged scam in which Lalu Prasad Yadav is accused of getting lands in the name of his family or close colleagues in lieu of jobs in Indian Railways between 2004 and 2009. According to the FIR lodged by the CBI, there were huge irregularities in Group D appointments in West Central Railway, Jabalpur (Madhya Pradesh) zone.

It is alleged that many candidates were taken from many candidates at a very cheap price or for free, which were later found in the name of people associated with the Lalu family. On 18 May 2022, the CBI had registered a case against several unidentified officials and private persons including Lalu Yadav, his wife Rabri Devi, daughters, Tej Pratap Yadav in this case. Tej Pratap Yadav was granted bail by the court on 11 March 2025, when he appeared in court in response to summons.

• Bail amount of Rs 25 lakh will have to be deposited.

Tej Pratap Yadav has received this relief at a time when Bihar’s politics is going through a period of upheaval. On the one hand, BJP and NDA are attackers about the allegations against the Lalu family, while RJD is calling it a political revenge action. Sanjay bhandari extradition case: Delhi’s Rousse Avnu Court heard a petition filed by the Enforcement Directorate (ED) against the famous arms dealer Sanjay Bhandari, demanding him to declare him a ‘fugitive economic criminal’. Bhandari’s lawyer also said that the ED’s petition does not fulfill the necessary conditions of the ‘Physical Economic Offenders Act’. He said that under this law, the accused can be declared a ‘fugitive’ only when the amount of allegations against him is 100 crore or more. But the Income Tax Department itself admitted in the Delhi High Court that the amount of alleged tax evasion and black money allegations against Sanjay Bhandari is less than 100 crores.

Sanjay Bhandari’s counsel alleged that when the ED filed this petition, there was no such assessment that confirmed 100 crores, yet the court was explained that this amount had crossed.

ED answer time, next hearing on 3 May

Special Judge Sanjeev Aggarwal gave the Enforcement Directorate till May 3 to respond to Bhandari’s arguments after hearing. The court said that time is given in the interest of justice. Now the counter debate on this petition will be heard on 3 May.

Significantly, Sanjay Bhandari’s name has also come in the investigation of money laundering against Robert Vadra, brother -in -law of Congress leader Rahul Gandhi. Apart from this, Mehul Choksi has also cited Bhandari’s case after recently rejected another extradition petition of the Government of India by the UK court.
