Hubli based Punashchitna Seva Sanstha had filed a petition in the High Court. At the same time, the Karnataka government led by Chief Minister Siddaramaiah has announced to challenge this decision of the High Court. Chief Minister Siddaramaiah said that the state government will file an appeal in the division bench of the High Court against the interim order of the Dharwad bench.</p>
<p style="text-align: justify;"><strong>Petitioner’s lawyer argued in court</strong></p>
<p style="text-align: justify;">A single bench of Justice Nagaprasanna has issued an order to put an interim stay on this order of the government and said that the next hearing in this case will be on November 17, 2025. On behalf of the petitioner, senior advocate Ashok Harnahalli argued in the court, ‘The government has ordered that permission will have to be taken for any gathering of more than 10 people. This is a restriction on the fundamental rights given by the Constitution. Even if a party is held in a park, that too will be considered an illegal gathering as per the government orders.</p>
<p style="text-align: justify;"><strong>Government order was issued in the beginning of this month</strong></p>
<p style="text-align: justify;">This government order, which was postponed by the Karnataka High Court, was issued earlier this month. In the order issued by the state government, guidelines were given that no private or social organization can organize any program, meeting or cultural event in government or public properties like government schools, college grounds or other institutional premises without written permission.</p>
<p style="text-align: justify;">In this order, the district administration was also directed to ensure that the rules are strictly followed and in case of any violation, action should be taken under the Karnataka Land Revenue Act and Education Act.</p>

State government minister Priyank Kharge said in this regard on Thursday (October 16, 2025) that the Karnataka Cabinet has decided to bring new rules to ban the activities of RSS.</p>
<p style="text-align: justify;">A day before this statement of Minister Priyank Kharge, on Wednesday (October 15, 2025), Karnataka Chief Minister Siddaramaiah had said that his government is considering ways to ensure that no organization harasses people.</p>

<p style="text-align: justify;">Priyank Kharge told news agency PTI after the cabinet meeting, ‘The rules that we are going to bring will be related to public places, government schools, colleges, government premises, government-owned institutions and aided institutions. We will make a new rule by bringing together the orders issued earlier by the Home Department, Law Department and Education Department. In the next two to three days, this new rule will be implemented within the ambit of the law and the Constitution.</p>
<p style="text-align: justify;"><strong>If you want to do anything, you will have to take permission from the government – Kharge</strong></p>
<p style="text-align: justify;">This decision of the Karnataka government is being considered as a big step towards banning the activities of RSS in government and government-aided schools and colleges of the state. Kharge further said, ‘We cannot control any organization, but from now on no organization will be able to do anything of its own free will in public places or on the streets. If you want to do anything, you will have to take permission from the government.</p>
<p style="text-align: justify;"><strong>Priyank Kharge wrote a letter to Chief Minister Siddaramaiah</strong></p>
<p style="text-align: justify;">Karnataka Minister Priyank Kharge had earlier written a letter to Chief Minister Siddaramaiah demanding a ban on RSS activities in government schools, colleges and state-owned temples. He had alleged that RSS was influencing the minds of the youth and promoting ideology against the Constitution.</p>
<p style="text-align: justify;">In a letter written to the Chief Minister, Kharge requested that like Tamil Nadu, such restrictions should be implemented in Karnataka also. After Kharge’s letter, Siddaramaiah directed the Chief Secretary to review the action taken on this matter.</p>
