Allahabad High Court Judge Sameer Jain has recused himself from hearing the case of SP leader Azam Khan. This is the case of orphanage eviction of 2016. Justice Sameer Jain has released the case from his court. The court also made it clear that the stay on the final decision of the trial court will remain effective till the next hearing.

In the petition, the trial court’s order dated May 30 has been challenged. In that order, the demand to recall the prosecution witnesses, especially Sunni Central Waqf Board Chairman Zafar Ahmed Farooqui and to bring on record the videography of the incident site, was rejected.

The petitioners say that this videography can prove their absence at the scene of the incident and this evidence is necessary for the right to a fair trial. This case is based on 12 FIRs registered in the Kotwali police station of Rampur in 2019, which include charges like robbery, criminal conspiracy and unauthorized entry into the house. All the cases were clubbed into a single case by Special Judge (MP/MLA) Rampur on August 8, 2024.

Prolonged imprisonment can cause severe mental illnesses like depression, anxiety, panic attack and even schizophrenia. India’s National Human Rights Commission (NHRC) report has recorded high levels of mental illnesses in jails.

Digestive diseases

Dirty and identical diet, low nutrition and water scarcity make constipation, acidity, ulcers and liver diseases common.

Asthama; Respiratory disease

Bronchitis, asthma and other lung diseases are also seen in prisoners due to dust, moisture and dirt.

High blood pressure and diabetes

Life diseases like high blood pressure and diabetes can increase due to prolonged stress, wrong eating and lack of physical activities.

Joints and bones problems

Lack of limited space of gel and lack of physical activity increases problems like tightness in the body, joint pain and arthritis.

Anemia and malnutrition

Prison food is often not rich in nutrition, which leads to deficiency of iron, vitamins and protein. Especially anemia is found more among women and young prisoners.

Eye and teeth problems

Due to lack of right health checkup for a long time, the eyesight, toothache and gum problems also become common.

What do doctors say?

Dr. Mohan Bairwa, Senior Doctor of Community Medicine Department at SMS Medical College, Jaipur, says that prisoners living in jail for a long time are the highest risk of mental stress, TB and skin disease. The main reason is congestion and lack of health service. Medical screening and mental health counseling of such prisoners is necessary from time to time.

Up news: Samajwadi Party leader and former MP Azam Khan from Allahabad High Court has got immediate relief. The Allahabad High Court has stayed the arrest of the SP leader in the case lodged at Ganj police station in Rampur in 2007. However, advance deliberations against Azam Khan will continue. The order has been given by the Division Bench of Justice Rajiv Gupta and Justice Ram Manohar Narayan Mishra.

Please tell that the plaintiff officer Khan had filed a case against SP leader Azam Khan on charges of demolishing the house on government land. After deliberation in this case, the final report came in 2007 itself, which was pending in the court of the judicial magistrate. After the death of Wadi Officer Khan in 2017, his son Zulfikar Khan filed a Protest Petition against the final report in 2024 after 18 years, on which the magistrate ordered an advance discussion.

At the same time, SP leader Azam Khan had filed a petition against this order to stop advance investigation and stop arrest. In this case, senior advocates Imran Ullah and Mohammad Khalid on behalf of the petitioner Azam Khan presented the arguments and the government made the arguments on behalf of Additional Advocate General Manish Goyal. The High Court has stayed the arrest of Azam Khan after hearing both sides.

Let us know that earlier Azam Khan had got a big relief from the Supreme Court, Azam Khan’s bail was approved in the Dungarpur case. Azam Khan was sentenced to seven years from the MP-MLA court in the Dungarpur case. In this case, Azam Khan has serious allegations like abusing robbery, homeless from home. At present, SP leader Azam Khan is lodged in Sitapur Jail.
