Uttar Pradesh Chief Minister Yogi Adityanath gave a big statement today on the occasion of the anniversary of Babri Masjid in Ayodhya. He said that today is a very special day because on this day the disputed structure was removed.

In a special program of HT, Chief Minister Yogi Adityanath said that any society should be proud of its heritage. Thanking the Supreme Court for the construction of Shri Ram temple in Ayodhya, CM Yogi said that everyone accepted that decision and today is a particularly important day. That controversial structure was removed on this very day. A stigma was removed and a heritage was restored.

CM Yogi thanked the Supreme Court for the construction of Ram Temple and said that we are thankful to the Supreme Court, which unanimously reviewed the facts and evidence presented and gave the verdict. This is the biggest victory of Indian democracy that everyone accepted this decision of the Supreme Court. He said that whatever may be the reason, this campaign will become an example for the development of the country for the coming generations.

A new debate may arise

Regarding Kashi-Mathura, CM Yogi said that ‘will reach and has reached’. Can start a new debate in the country’s politics. The case of both the disputed sites of Varanasi and Mathura is in the court. Such an interpretation has exposed the vision of the BJP and the Sangh within it.

The suspected death of Nikki Bhati on August 21 in Greater Noida shocked everyone. The biggest mode of this case came when a video of Nikki’s 6 -year -old son came out. Innocent said in his statement that the father beat the mother and then burnt to death. This testimony viral on social media can now be important for both investigation and court. The question is how much the testimony of children in the court is valid and in which cases the statement of the innocent has changed the direction of the entire case.

How much valid children’s testimony in court

There is no minimum age fixed in Indian law to become a witness. Under Section 118 of the Indian Evidence Act 1872, if the court feels that the child can differentiate between truth and lies and keeps his point properly, then his statement will be considered completely valid. Recently, the Supreme Court has also made it clear that child witnesses are capable witnesses and their testimony cannot be rejected only on age basis. The courts only take care that the child is not making a statement in any pressure, fear or tutoring.

Child testimony changed when the case changed

1. Madhya Pradesh case. A 7 -year -old girl saw her mother being killed and testified in court. The High Court had acquitted the accused as a child’s testimony, but the Supreme Court said that the child witness is completely valid and on this basis the accused was sentenced to life imprisonment.
2. Bareilly case. Her 11 -year -old son and 8 -year -old daughter testified in the suspicious death of a woman named Vandana. The children had testified that the father used to beat the mother every day and beat her up and also beat up on the day of the incident. The court, considering the testimony of the children as reliable, sentenced the father to 10 years.
3. Secrets open by drawing. In another case, a 7 -year -old girl saw her father killing her mother. During interrogation, the father narrated the story of suicide, but the drawing made by the child removed the curtain from the truth and the accused was convicted.

How is testimony from children

The way of recording children’s statements is completely different from common people. Child witness rooms are made for this in the court where children are given toys, chocolate and comfortable environment.

• The children do not look at the accused directly in the court room, but by looking at the judge on the screen from a separate room, they answer the questions.
• At such a time, the judges ask the children very simple and lovingly.
• The face of the accused is also shown to the child for just a few seconds so that he does not get scared.
• Children’s identity and name are also kept confidential during testimony

The statement of her son in Nikki Bhati case can give a new direction to the investigation. This testimony can prove to be an important evidence for the court. In fact, many times the true testimony of innocents has done the work in the court which could not even do strong evidence. That is, if the child understands the difference between the truth and the lie and makes a statement without pressure, then his testimony can be completely reversed.

The Supreme Court has refused to hear the petition alleging fake degrees against Uttar Pradesh Deputy Chief Minister Keshav Prasad Maurya. The Supreme Court has refused to intervene in the Allahabad High Court order which came on 7 July. The High Court dismissed the petition of Diwakar Nath Tripathi and stated him with malicious.

The appeal of petitioner Diwakar Nath Tripathi against the High Court’s decision was engaged in the bench of Supreme Court Justice Sudhanshu Dhulia and Justice Arvind Kumar. The judges refused to change the decision of the High Court.

Lower court files FIR in case

The petitioner had alleged that Keshav Prasad Maurya submitted a fake degree to contest elections and get a petrol pump dealership. On September 4, 2021, the lower court refused to order an FIR in the case. The ACJM court had said that no crime is made against Maurya.

Court’s stand on the complainant

The petition filed against this order was also rejected by the High Court. The High Court had said that the complainants are not affected in this case. It seems that he started proceedings with malicious purpose. The purpose of the complainant seems to be taking some advantage or disturbing Maurya.

Asaduddin Owaisi on Bihar Voters List: Hyderabad MP and AIMIM chief Asaduddin Owaisi has welcomed the Supreme Court’s decision that has been instructed to recognize 11 documents as well as three more documents – Aadhaar card, voter ID (EPIC) and ration card along with 11 documents already existing for voter verification in Bihar elections. Owaisi has described it as ‘an important step’ towards strengthening the voter verification process.

Not only records, strong evidence of identity
The Supreme Court has clarified in its order that these three documents can be used not only for records, but as proof of birth date and place of birth. Owaisi said that this decision follows the legal vision of the 1995 Babu Lal Hussain case and should be fully implemented.

AIMIM’s petition and legal effort
On this issue, AIMIM’s Bihar President Akhtarul Iman filed a petition in the Supreme Court. Senior advocate Mohammad Nizam Pasha advocated on his behalf. Owaisi appreciated this legal effort and said that this step has been taken to protect the rights of voters of Bihar.

Questions raised on ECI’s ‘misinterpretation’
However, Owaisi has questioned some ‘sources’ of the Election Commission (ECI). He says that these people are misinterpreting the order of the Supreme Court and considering it limited to keeping it only. He reiterated that this order is to make voter verification transparent and reliable.

Part of intensive revision process in Bihar
This order has come under the ongoing Intensive Revision process in Bihar, which aims to make the voter list updated and accurate. Owaisi said that this decision will strengthen voter identity not only in Bihar, but in the whole country.

AIMIM’s appeal – keep the documents ready
AIMIM has appealed to the voters to keep their documents – Aadhaar, Voter ID and Ration Card ready so that there is no obstruction in the verification process. The party has also spoken of spreading awareness on this issue.
