Big relief has been received from the Allahabad High Court in the alleged sexual harassment case registered against Swami Avimukteshwaranand Saraswati in Prayagraj. The High Court told the lawyers associated with the case in its chamber that there will be a stay on the arrest of both Swami Avimukteshwaranand and Mukundanand till the next hearing.

The detailed order of the court can be uploaded on the High Court website by night. In this order it will also be mentioned on which date the next hearing will be held in the third week of March. Till then no arrest will be made against the two accused, although the police can interrogate if they wish and Shankaracharya will have to cooperate fully in the investigation.

Justice J.K. Sinha’s bench reserved the decision after hearing the arguments of both the sides. Due to the huge crowd and hustle and bustle of advocates in the court room, the hearing was conducted in the chamber, where only the lawyers associated with the case were present. During the hearing, the court also asked the defense why the Sessions Court was not approached first and what was the justification for coming directly to the High Court. On behalf of the state government, Additional Advocate General Manish Goyal mainly objected to the maintainability of the anticipatory bail application.

He said that the petitioner should have first gone to the Sessions Court and challenged the order there, it is not appropriate to come directly to the High Court. The government also said that the matter is related to the FIR registered on the orders of the court and the investigation is being conducted on scientific basis. The statement of the complainant has been recorded and in the further investigation the statements of the accused will also be recorded. It was also clarified by the government that if there is a possibility of destroying evidence or influencing the alleged victims and witnesses, then arrest action can be taken.

Senior advocate Dilip Gupta, while presenting arguments on behalf of Swami Avimukteshwarananda, said that full cooperation will be given in the police investigation. The defense, citing the alleged criminal background of the complainant Ashutosh Brahmachari alias Ashutosh Pandey, placed his criminal history before the court. It was also said that among the children who have been accused of exploitation by labeling them as minors, one of them has been claimed to be an adult on the basis of his mark sheet.

Swami Avimukteshwarananda Saraswati said on Friday that if a narco test is necessary to find out the truth in the case registered against him under the Protection of Children from Sexual Offenses (POCSO) Act, then he is ready for it.

He told reporters, ‘If the truth can come out through narco test then it must be done. Whatever methods are available should be adopted to reveal the truth.

Narco test is a scientific investigation process, in which a drug like ‘Sodium Pentothal’ is given to a suspect. Due to its effect, he does not remain completely conscious, but can answer questions, which increases his chances of telling the truth. This test is done under the supervision of experts only after the permission of the court and the consent of the person.

The saint’s anticipatory bail petition can be heard in the Allahabad High Court on Friday at around 4.45 pm. His disciple Sanjay Pandey said that Swami was participating in his regular religious activities and offered prayers as usual. A large number of media persons were present in the Math.

Avimukteshwaranand said that his lawyers are present in the court and will present all the evidence before the court.

He said that even if some wrong incident has happened, it does not automatically prove who is responsible for it. He said, ‘It is not easy to add our name to a child who never came to us.’

Avimukteshwaranand alleged that the children were living with complainant Ashutosh Brahmachari alias Pandey and raised questions as to why they were not sent to a juvenile home.

Citing media reports, he claimed that the children were kept in a hotel in Hardoi and were not allowed to meet journalists.

‘The truth will eventually emerge’

He accused the police of giving protection to the complainant and getting the statement prepared against him. Avimukteshwarananda said, ‘No matter how fabricated the story is, the truth will eventually emerge.’

Earlier on Thursday, Swamy had termed the case registered under the POCSO Act and relevant sections of the Indian Judicial Code as ‘false’ and alleged that it was an attempt to defame him and divert attention from the world famous ‘Epstein Files’.

He said that to protect the dignity of the institution he represents as the Shankaracharya of Jyotirmath, he has approached the High Court for anticipatory bail.

He also said that neither he nor his Gurukul has any connection with the complainants.

Shankaracharya of Jyotishpeeth, Swami Avimukteshwaranand Saraswati has sent a legal notice to the Uttar Pradesh government through his lawyer. The notice clearly states that if the January 19 notice related to the fair administration is not withdrawn within 24 hours, then legal action including contempt of court will be taken against the government and the responsible officials.

According to the legal notice, the January 19 notice has been described as damaging to Swami Avimukteshwarananda’s reputation, honor, dignity and his financial resources. It has also been said in the notice that this letter interferes in a matter which is already under consideration in the Supreme Court. This has been described as a step challenging the dignity of the court.

The notice warns that if the letter is not withdrawn within the stipulated time, action will be taken under the Contempt of Court Act 1971 and Article 129 of the Constitution. Along with this, legal action will also be taken against the charges of hurting Shankaracharya tradition and Swamiji’s image.

Later, Swami Avimukteshwaranand filed another application in the Supreme Court on March 9, 2024, demanding action against Swami Vasudevanand Saraswati for perjury. He says that the court was misled on the basis of wrong facts.

Now all eyes are on what steps the Uttar Pradesh government takes within the time limit of 24 hours. If the letter is not withdrawn, the matter may once again reach the Supreme Court and the legal battle is likely to intensify.
