Tenant Rules: A large number of people in the country live in rented houses. Lakhs of people run their businesses from rented shops. In many families these shops are generations old. Whom Dada or Baba had once given on nominal rent. With the passage of time, it becomes a big legal dilemma. In cases that are 40–50 years old, the current owners feel that it is almost impossible to vacate the shop now.

But the recent decision of the Supreme Court has changed this thinking. The court clearly said that mere possession for a long period does not confer ownership rights on the tenant. If the real owner or his heirs prove genuine need. So the law stands with them. Know how you can get the tenant to vacate the shop in such a situation.

This is how you can get your shop vacated

If Baba had given any shop on rent. But the current owner is his heir. So in such a case, the Supreme Court accepted that the right to property is not limited only to the first generation. If the next generation needs a shop, that too will be considered completely legal.

In such a situation, the landlord can argue in the court that he needs a shop. He himself wants to start his own business there. In such a situation, the court can order the tenant to vacate the shop after seeing the rights of the landlord and accepting his arguments.

Long possession does not give rights

Recently, in one such case, the tenant argued that he has been running the shop for about 50 years and the upper floors can be used as an option. But the Supreme Court rejected these arguments outright.

The court said that the tenant cannot instruct the owner how to use his property. Besides, issues like electricity connection were also considered unnecessary. The court said that the need is assessed from that date. When the suit was filed and not because of later changed circumstances.

This is the whole process

To evict a tenant from the shop, it is first necessary to check the rent agreement and ownership documents. If there is a written agreement, check its terms, if not, check the rent receipts. After this decide the valid reason. Such as personal or family business needs, non-payment of rent, misuse or dilapidated condition.

After this, send a legal notice through Makil and give a stipulated time. If the shop is not vacant even after the notice, file an eviction case in the rent control court. After the court order, if necessary, the shop can be vacated through legal process.

New Rules For Security Deposit: There are many people in the country who do not have their own house. They have to live in rented houses. There are many people who live in another city due to work or some other reason. There they have to live in a rented house. But many things are like this for those living on rent. Which has often become a cause of trouble for them.

The most common problem is that landlords decide the security money and rent as per their wish. At some places, security of 5-6 months is asked. So somewhere the fare increases without any notice. But this will not happen now. Now landlords will not be able to demand security deposit as per their wish. The government has made arrangements for this.

There will be no arbitrariness in security deposits

Currently, there are many landlords in the country who charge the desired amount as security deposit. To stop this, the government is insisting on implementing the Model Tenancy Act in the entire country. It has been made clear in the new Rent Rules 2025 that now the limit of security deposit will be fixed. The rent will not increase arbitrarily and no one will be evicted from the house without any reason. This change has brought great relief to the tenants.

Also read: Start this smart business sitting in the village, you can become a millionaire in a few months.

Under the new rule, only a maximum of 2 months’ rent can be kept as security for residential property. Whereas for commercial spaces like shops and offices, this limit has been fixed at 6 months. This will reduce the pressure on tenants to deposit huge amount suddenly and it will be easier than before to take a house on rent. Often people used to shy away from taking rent in the name of security.

Rent will not be given without written agreement

After Model Tenancy Act, written rent agreement has now become mandatory. In this, things like rent, its increase, responsibility for repairs, notice period and rental period will be clearly written. It will be necessary to submit it to the rent authority within 60 days of making the agreement.

Also read: Residence certificate will now be made in minutes, know which documents will be required for this

Along with this, states will also have to create an online platform. Where the rent agreement will be registered in digital form. This record will be legally valid and will become the biggest evidence in any dispute. This will provide transparency to both the tenant and the landlord so that later neither party will be able to change the terms as per their wish.

Also read: Government gives you money if you buy a car above Rs 10 lakh, if you know this rule then it will be beneficial.

The Supreme Court, while hearing a case related to the Bombay High Court, has expressed concern over the delay in the decision in the dispute between the property owners and teachers. A bench of Justice Sanjay Karol and Justice Manoj Mishra has “requested” the Chief Justice of the Bombay High Court to review such cases pending there.

The Supreme Court is hearing the appeals against the High Court order related to the dispute on ‘per square foot rate’. This case is related to renting the ‘Harchandra House’ in Mumbai by Hindustan Organic Chemicals Limited. The bench said that in some cases the litigants have to wait for years to settle their disputes.

The bench said, ‘When it comes to the landlord-owner dispute, it also includes aspect of being deprived of the benefits of one side and the aspect of being denied monetary benefits from the other party’s ownership. It is the duty of the courts to ensure that they do not have trouble due to them. ” The court said that taking a delay in such disputes means that both sides have to bear the brunt of it.

The bench said, “In some cases the landlord has to suffer losses due to lack of property, and in other cases, the monetary amount is not received from it. The tenant has to suffer losses because the final decision in the case is directed to pay a large amount in a short time when the final decision comes.” The apex court said that it is a difficult task for tenants to make requisite arrangements to pay such a huge amount.

The bench said on May 6, “We request the Chief Justice of the Bombay High Court to ask for a report from the courts concerned about the pending period of landlord-owner disputes.” The court said that if it is found that there are many other cases like this case, the High Court should take ‘appropriate steps’ for their early disposal.

Rules for tenant: Often people have to leave their cities in connection with work and go to another city. Many times people leave small town and shift to a big city. So many times people shift to another big city except one big city. People go to a new city and find a home to live first. People in new cities remain on rent.

So many times people in big cities rent their empty big houses to earn. And now it has become very common for some time. But let us tell you if someone stays in your house as a tenant for a long time. So he can claim your flat. Let us tell you what are the rules about this.

After 12 years, tenant can claim flat

In fact, if a tenant is living on a flat without any objections for 12 consecutive years and the landlord has not taken any legal action against him. Then in such a situation, he can claim that flat under the tenant adversaries possession.

Also read: Use this thing while running AC, thousands of saving will be saved in electricity bill

However, only by claiming that flat tenant will not get it. He will have to show some important documents for him. Such as electricity bill, water bill, property tax papers. If all these documents are with him. And the landlord does not know by opposing them. Then the tenant may be occupied by the flat.

Also read: Is electricity going to be expensive in Delhi? Know your meaning of your meaning

Tenant will not be able to claim in this case

Let me tell you if a tenant is living in your flat with a rent agreement. So in such a situation, he cannot claim. Apart from this, you have to bill the water in the name of the tenant. And no electricity bill. If you feel your tenant behavior is not right. So you can ask him to vacate your flat. For this you can give him notice. If you do not take care of these things. Then you can wash your hands with your flat.

Also read: This important work will be done before the 20th installment of PM Kisan Yojana, this important work will not be done
