The Lucknow bench of the Allahabad High Court on Friday expressed displeasure that despite prior orders, the state government did not give a clear answer as to what it would do if a political party organizes a caste-based rally.

The High Court has fixed October 30 for the next hearing of the case. The division bench of Justice Rajan Roy and Justice Rajiv Bharti expressed displeasure during the hearing of the PIL of local advocate Motilal Yadav.

High Court sought response from the state government

The High Court had banned caste-based rallies from July 11, 2013. The division bench ordered the state government to file an affidavit within three days in compliance with its order dated August 7, 2024, otherwise the concerned principal secretary will have to appear in the court on the next hearing.

During the hearing, the counsel for the state government told the court that the state government has issued a government order dated September 21, 2025, banning caste-based rallies for political purposes in the state. On this, the court asked the state government’s counsel as to what was the problem in filing the affidavit in this regard.

Ban on caste based rallies

In the last hearing, the Election Commission had also said that it has completely banned caste-based rallies under the model code of conduct. The court had sought clarification from the state government about its authority to take action. But, no clear answer was given, which angered the bench.

The court had banned caste-based rallies by political parties in the state on July 11, 2013. Passing an interim order, the court had said that the caste system divides the society and creates discrimination. The court had said that allowing caste-based rallies is a violation of the spirit of the Constitution, fundamental rights and responsibilities.
