US Trump Tariffs: US President Donald Trump suffered a major setback when the Supreme Court of the United States declared several high import duties (tariffs) imposed by him invalid. Through these tariffs, the US administration had collected revenue of about 134 billion dollars. Now the biggest question is to whom and how will this amount be returned?

The tariff was not a tax collected directly from ordinary American citizens. This was a duty imposed on imported goods, which was paid to the Customs Department by companies importing goods into America, such as Walmart and Costco. That means they were legally paying companies. However, in practice, companies add this additional cost to the prices of their products, leaving the ultimate burden on consumers.

For example, if a 15% tariff was imposed on an electronic item, the importing company paid that duty to the government, but later collected it from the consumer by increasing the price in the same proportion.

 Who will get refund?

From a legal point of view, refund is given only to the entity which has made the payment to the government. Since the customs duty was paid by the companies, if the refund process starts then it will be given to the companies only and not directly to the consumers. It is not possible to make direct payments to consumers because they do not pay any direct taxes to the government.

The refund process is not easy. Companies will have to prove how much tariff they had deposited during which period and which falls in the invalid category under the court’s decision. After this there will be review by customs authority, documentary investigation and legal procedures. This may also include the issue of interest payment.

How much time can it take?

President Trump has indicated that the entire process may take up to five years. The reason is that thousands of companies and crores of import transactions will have to be reviewed. Apart from this, the government can also see whether the earlier revenue can be compensated by implementing new tariffs under any alternative legal provision. Impact on consumers: Even if companies get refunds, it is not necessary that they return the amount to consumers.

Companies can use that money to cover their losses, strengthen their balance sheet or invest in future investments. Therefore, the possibility of the general public getting a direct refund is considered very low.

Trump Tariffs: Last week, businessmen got relief when the Supreme Court of the United States banned Trump tariffs. But soon after that, President Donald Trump announced the imposition of a global tariff of first 10 percent and then increasing it to 15 percent. Now there are indications that this series of tariffs will not end here. New investigation on national security grounds According to Bloomberg report, the US administration is investigating the impact of imports on sectors like batteries, electric grid equipment, telecom equipment, industrial chemicals, plastics, plastic pipes and cast iron.

Is the tariff game yet to come?

This proposed investigation will be conducted under Section 232 of the Trade Expansion Act of 1962. This provision allows new tariffs to be imposed on national security grounds. This development has come to light at a time when a new global tariff has been announced after the decision of the Supreme Court. According to officials, the 10 percent tariff will come into effect from Tuesday morning, although Trump has talked about increasing it to 15 percent.

 New rates for five months

The new rates of global tariff have been implemented for the next five months. Meanwhile, the Trump administration is also working on the option of an alternative import tax to compensate for the tariffs rejected by the court. Trump’s warning: On Monday, Trump had warned that heavy tariffs could be imposed on countries that try to take advantage of the Supreme Court’s decision.

Trump’s new threat

After the Supreme Court set limits on the use of emergency power, the administration is also considering other legal options, so that business strategies and agreements can be maintained. European Union’s response: On the other hand, the European Union has currently put on hold a possible trade agreement with Washington.

European lawmakers have made it clear that they will move forward only after receiving detailed clarification on the US administration’s tariff policy. That is, there remains uncertainty in the global trade environment and more major developments regarding tariffs may be seen in the coming days.

America has implemented 10% global tariff with immediate effect. A White House official has confirmed that this tariff will remain in effect until another legal authority is implemented. India will also be included among the countries paying 10% tariff under this new system. When the official was asked whether India would have to pay 10% tariff and whether it would replace the old tariff imposed under IEEPA (International Emergency Economic Powers Act), he clearly said, ‘Yes, 10 percent will remain in force until any other authority comes into force.’ The official also advised all trade partners to abide by the trade agreements made with the US.

According to ANI report, this decision has come at a time when the US Supreme Court, with a majority of 6-3, gave a big blow to the Trump administration. The court said that under the IEEPA Act of 1977, the President does not have explicit authority to impose blanket import duties. According to the Constitution, this power rests with Congress. Chief Justice John Roberts along with Neil Gorsuch, Amy Coney Barrett and three justices joined the majority. Justices Samuel Alito, Clarence Thomas and Brett Kavanaugh dissented and supported the administration’s powers. This decision has invalidated billions of dollars of “reciprocal” and tariffs. It is estimated that the government may have to face refund claims ranging from 130 to 175 billion dollars.

Trump called the decision ludicrous

President Trump described the Supreme Court’s decision as terrible and ludicrous. He said, ‘The court said that I cannot take even 1 dollar under IEEPA. I can close down business, end the country’s trade system, but can’t impose a $1 fee, how ridiculous is this?’ Trump alleged that the court is influenced by foreign interests and said that other countries are happy with this decision, but will not dance for long.

New tariff under section 122

After the Supreme Court’s decision, Trump announced signing an executive order to impose a 10 percent global tariff under Section 122 of the Trade Act of 1974. This provision allows for the imposition of a temporary tax of up to 15 per cent for 150 days, specifically to address the balance-of-payments deficit. Trump clarified that the tariffs already implemented under Section 232 (national security) and Section 301 (unfair trade practices) will remain in full effect.

Impact on India-US trade agreement

Trump said the ongoing India deal, which reduced reciprocal tariffs to 18%, would be maintained under the new legal process. This situation could be complicated for India, because the 10% global tariff will be applicable on top of the existing duties. This may affect exports, especially steel, aluminium, auto parts and textile sectors.
