Filing an FIR is considered the most important process in the Indian legal system. Investigation of any crime starts only when an FIR is registered in the police station. But often the victims faced the problem that the police station refused to register the case saying that the case was not within their jurisdiction. In such a situation, the victims kept wandering here and there and sometimes due to delay the evidence also got destroyed. To solve this problem, the concept of Zero FIR was brought. This rule is part of the amendments made especially after the Nirbhaya case so that the victim can get immediate relief and the criminal does not get a chance to escape punishment.

What is FIR?

FIR i.e. First Information Report is the first written report that the police files on receiving information about a crime. It is registered only in the police station in whose area the crime took place. For example, if any incident of theft, robbery, murder or rape has happened in any area, then the FIR will be registered in that police station. After this the police of that police station starts investigation and action. It is legally mandatory for the police to register an FIR.

What is zero FIR?

Zero FIR means that no matter where the crime took place, the victim can go to any nearest police station and lodge a complaint. In this, the number of FIR starts with “0” (Zero), hence it is called Zero FIR. Later this case is transferred to the police station of the concerned area. Its biggest advantage is that there is no delay in filing the complaint and investigation starts immediately.

Why did the concept of zero FIR come into existence?

After the Nirbhaya gangrape case (2012), when outrage spread across the country, it was seen that many times the victims face a lot of difficulty in filing complaints in the police station. Police officers used to postpone the matter saying that it was not a matter of their area. For this reason, the provision of zero FIR was added to the Criminal Law (Amendment) Act made in 2013. The Home Ministry and the Supreme Court also made this system mandatory so that the victim can get immediate justice process.

Whenever a person is crime in our country, such as assault, theft, molestation or any kind of threat, the first step is to go to the police station and register an FIR (first information report). FIR is such a document. Due to which the police officially get the information of the crime and then the police starts investigation on the basis of that. But many times it happens that the victim reaches the police station and the officers present there refuse to register an FIR. Some people return home after refusing because they do not know about further processes. However, even in the event of not registering an FIR, citizens have many options and the law gives them full rights to demand justice. At the same time, many information is available on such complaints on social media too. So let us tell you today that if the police is not registering an FIR, then before going to the police station, call the number and how can you complain if the FIR is not registered.

If the police refuse to register an FIR, call the number on which number
If a crime has happened to you and the police is not registering an FIR, then there is no need to panic, you have many legal options. But recently, under a viral video, a police officer has described easy and very important rules. Through which you refuse to register the police FIR, then you can complain. For this, before going to the police station, call the number 112. When you are going to register an FIR, call 112 on the way and inform that you are going to register an FIR. This call will remain in record and later you will work as evidence.

112 is a single emergency number to be dialing in a big difficult or crime. On which 24 hours and seven days can be made in all the states and union territories of India and seven days for immediate help from the fire brigade, a medical team or police. You can call number 112 with a landline or mobile phone. This single emergency number is free everywhere.

If the police refuse to register an FIR, where to complain
In the event of FIR not registering, you can send a complaint to the SP, DCP or DIG of your district. If they feel that the matter is correct, they can order an officer to investigate. Apart from this, even if the crime has been done in another police station area, you can still register an FIR in any nearby police station. This is called Zero FIR. The police have to accept it and send it to the concerned police station area.

Along with this, if the police and high officials are not taking your FIR, then you can go to the Magistrate in the District Court and give the complaint application.
Magistrates can order the police to register an FIR and order an inquiry. Nowadays almost every state police website or mobile app is from where you can enter E-FIR. In this, you can upload developments and evidence. If you feel that injustice has been done to you and the police is deliberately negligent, then you can complain to the National Human Rights Commission (NHRC) or the State Human Rights Commission.
