Tahawwur rana extradition: Tawwur Rana, accused of 2008 Mumbai terror attack and most wanted terrorist, is being brought to India. The US Supreme Court and the country’s Chief Justice John Roberts dismissed the appeal of Tehwwur in which he demanded a ban on being sent to India.
Tehwwur Rana had said in the court that if he was sent to India, he could be mentally and physically badly behaved, but the court rejected his request.
Tehwavur Rana gave these arguments in court
Tehwavur Rana had argued in the US court that when a case has already been reported against him in America, now a case cannot be run again in India. During this time, the Government of India and its lawyers told the court that this argument of Tahwwur is not correct. He said that according to international law, the allegations against Tahwwur Rana are very serious, so he can be sued in India too.
If sources are to be believed, there was an attempt in 2010 and 2012 for the extradition (bringing India) of Tahwwur Rana, but serious discussion on it started from 2018. Another important thing has come to light that the US court has clearly stated that a case can be run against Tahwwur Rana in India only in the same sections, which America has given permission. This means that India cannot add any new or other section. Right now the lawyers of India have been asked to be vigilant. As soon as Tahwwur Rana reaches India, then it will be decided what will be the next legal process. According to sources, after bringing India, the investigating agencies will get 24 hours to present Tehwwur in the court.
The first charge sheet was filed in 2011
The first charge sheet in India was filed against Tahawwur Rana, accused in the 26/11 Mumbai attack, in 2011. Earlier, a case was registered against him in America in 2009. In 2013, he was sentenced to 14 years in jail by a US court, but the US Supreme Court allowed him to extradite India before his sentence was completed. Rana then sent a petition to US Chief Justice John Roberts and requested to stop the extradition, but was also rejected.
