Illegal relationship out of marriage is not a crime

Earlier, having a relationship with someone else out of marriage, used to fall under the category of crime. Under Section 497 of the IPC, there was a provision of punishment of five years. However, only men used to get punished under this section, which had a dispute about. Taking a historic decision in 2018, the Supreme Court had abolished this section, after which if two people make a relationship with mutual consent, then it is not considered a crime. In the Indian Code, which was implemented in 2024, it was not classified as a crime for mutual consent outside the marriage.

Can be the basis of divorce

It is worth noting here that even if the relationship with someone else is not a crime after marriage, but it can be the basis of divorce. If a woman or a man has an illicit relationship despite being married, then his partner can go to court on the basis and demand divorce. As far as Tej Pratap Yadav and his wife Aishwarya Rai are in case, their divorce case is already pending in the court.
