The Supreme Court has changed the order to remove a judge of Allahabad High Court from hearing of criminal cases. Some other judges including the Chief Justice of the Supreme Court had expressed concern over this order of the bench of Justice JB Pardiwala and Justice R. Mahadevan. 13 judges of Allahabad High Court also wrote a letter to their Chief Justice asking them not to accept this order. He said that the Supreme Court does not have administrative control over the High Court.

The case was settled by the Supreme Court on Monday, August 4, but it was once again deployed for hearing on Friday (August 8, 2025). Justice Pardiwala, while reading a written order, said, ‘The Chief Justice of India had requested a change in the order. Due to this, the matter was listed again. Our aim was not to embarrass the judge or attack them. Our concern is about the honor of the people towards the judiciary.

Justice Pardiwala further said, ‘We know that the Chief Justice of the High Court is the Master of Roster. We do not want to interfere in their administrative work. In our previous order, we are removing the paragraphs written about the judge on 25 and 26 and leaving the subject for the view of the Chief Justice of the High Court.

On August 4, a two -judge bench of the Supreme Court gave strict orders about Justice Prashant Kumar of Allahabad High Court. The judges had asked the Chief Justice of the Allahabad High Court to sit Justice Prashant Kumar in the division bench with a senior judge. If it is necessary to sit in a single bench ever, then do not let any criminal case listen.

The judges, who were upset with the decision of Justice Prashant Kumar, who justified criminal cases in the civil dispute, said, ‘We have not yet seen a bad order from it. The judge who has ordered justice has made fun of justice. Sometimes one has to think whether such orders are given due to lack of knowledge of law or due to any external reason.

The case that the Supreme Court had expressed displeasure was a business dispute between 2 companies. One party had registered a criminal case in Kanpur after not getting payment from the other party. In the order given on 5 May 2025, Justice Prashant Kumar said that the civil case lasts for a long time, so the criminal case filed by the victim company will not be canceled.

Angered by the verdict, the Supreme Court quashed it without issuing notice. Sending the matter back to the High Court, he had asked the Chief Justice of the High Court to put it up to another judge for hearing. Also, Justice Prashant Kumar said that as long as he is in office, he should never be allowed to hear any criminal case.

Now the Supreme Court has withdrawn that part of its order. However, the judges have reiterated the concern that civil matters are being registered in UP like a criminal case. The court has said, ‘The High Court is the last court for 90 percent of the people. Not everyone is able to come to the Supreme Court, so the High Court should take the right decision from legal point of view.
