Up news: The Lucknow bench of the Allahabad High Court rejected the petition of Congress leader Rahul Gandhi on Thursday, which challenged the subordinate court summons against him on the complaint against his alleged derogatory remarks about the army during the ‘Bharat Jigo Yatra’.
The Lucknow bench of Justice Subhash Vidyarthi passed this order and said that it would issue a detailed order by Monday.
Earlier, a group of state lawyers, including Additional Advocate General VK Shahi, government lawyer VK Singh and Additional Government Prosecution Anurag Verma, stressed that the petition is not to consider the High Court, as the petitioner has an alternative way to challenge the summary order before the session court.
He also said that on the basis of the complaint and statement of the witnesses, prima facie crime is detected against him. Gandhi had challenged the summons order and the complaint and argued that it had been filed under malicious intention.

What is the matter?
Complainant Uday Shankar Srivastava, in his petition filed in a court here, alleged that during the December 2022 visit, Gandhi allegedly made several derogatory comments about the Indian Army in the context of the struggle with Chinese soldiers.
The Congress leader’s advocate Pranshu Aggarwal argued that only by reading the complaint letter, the allegations seem to be of concoction.
He also argued that Rahul Gandhi is not a resident of Lucknow, so before being summoned on the said complaint, the court should have investigated the truth of the allegations and he should have been summoned only after being found to be hearing.
However, the High Court rejected these arguments.
