Us President Donald Trump: The 6-3 decision given by the Supreme Court of the US not only gave relief to President Donald Trump, but has also intensified the debate over the balance of power in the American constitutional system. The court clearly stated that the nationwide prohibitions issued by the judges of the district courts could be out of their legal limit.

Trump called it a tremendous victory and indicated that he would now re -implement all the policies that were earlier stayed by the courts. It also includes an order to abolish the citizenship received from birth, which was described by the courts as unconstitutional. This decision does not directly decide whether Trump’s order is valid or not, but it focuses on whether the same judge should have the right to stop any order for the whole country.

New definition of constitutional powers?

This decision limits the power of the judiciary, which was able to curb top officials like the President till now. Traditionally, the courts have issued nationwide prohibitions and maintained the policies of the executive in accordance with the constitution. Supreme Court Justice Amy Koni Barrett wrote in his majority judgment, “Federal Courts do not monitor the executive branch.” This statement makes it clear that the courts will now take care in stopping the policies, which can open the hands of the executive. While the disagreement of Justice Sonia Sotamayor is reflected in deep concern. He wrote, “There is no right in the new legal rule created by the court.”

Democrats raging on court order

Democratic leader Chak Shumar described the verdict as a terrible step towards totalitarianism. He feared that it would exclude leaders like Trump from judicial accountability. Democrats believe that Trump is already misusing executive powers and now this decision will give them more open exemption.

Trump’s disputed order attack on birthright citizen

Trump’s effort to end the birthright directly challenges the 14th amendment of the US Constitution, which clearly states that every person born in the US is an American citizen. Trump claims that this policy was made only for the children of slaves, while its scope is much wider than that. It was clarified in his order that if parents are living illegally or in America on visas, then their children will not get citizenship. This policy was already unconstitutional by the courts of states like Maryland, Massachusetts and Washington.
