Animals cannot speak like humans, nor can they say their problems and some people take advantage of this compulsion in a very disgusting way. People often ask the questions about crime like sexual abuse with animals, that is ‘Bestiality’, whether there is any strict law for it in India? Are such criminals punished severely. Let us know what is the law in India regarding sexual offenses with animals.

Sexual offenses against animals in India

On behalf of the Federation of Indian Animal Protection Organization, 2 petitions have been filed in the Delhi High Court regarding the sexual offenses and cruelty of animals. These petitions cite Articles 14, 21, 48A and 51A (G) of the Constitution and demanded protecting animals as a sensitive creature.

Let us tell you that in Shahdara, Delhi, a person was arrested on charges of sexual abuse with many dogs. A condom was found in a dog’s private part in Saket, Delhi, a person was caught sexually abusing the dog in Coimbatore. People in India do not take much serious sexual abuse against animals unless there is a big opposition in such a case.

According to data from the National Crime Records Bureau, around 1 thousand cases were registered in Section-377 between 2019 and 2022, although it is difficult to tell how many of these animals are associated with sexual abuse.

Law in India

At present, there is no strict punishment law in India for sexual exploitation of animals. During the British rule, it was considered a crime under IPC Section 377 in the year 1860 and cases were registered against it. In the year 2018, it was canceled to some extent by the Supreme Court, which was completely removed during Indian justice and thus there is no such law within India under which sexual abuse against animals can be registered.

However, even today, IPC Section-377 started in the British era in Pakistan and Bangladesh has been implemented. The Government of India had prepared a draft by adding the definition of sexual violence in the Animal Cruelty Act in the year 2022, although it has not been introduced in Parliament till date.
