In such a situation, the question arises that if Dharmendra’s property is divided then who will be entitled to it? Delhi High Court lawyer Kamlesh Kumar Mishra had told ABP News that after the 2023 Revan Siddappa vs. Mallikarjuna decision, the second marriage of a person is considered invalid under the Hindu Marriage Act (HMA). Even then the children born from that marriage will be considered legitimate in the eyes of the law.
Under Section 16 (1), such children will get full rights on the property of their parents. However, this right will be limited only to the property of the parents, there will be no direct right over the ancestral property.
That is, after Dharmendra, it will be considered that his ancestral property has been divided and the share that comes in Dharmendra’s name will be divided equally among all his legitimate heirs.
Dharmendra’s first wife Prakash Kaur, children from the first wife – Sunny Deol, Bobby Deol, Ajita Deol and Bobby Deol, daughters from the second marriage – Esha Deol and Ahana Deol will get equal rights in the property.
Second wife Hema Malini will not get any share in Dharmendra’s property. Because their marriage is not considered valid under the Hindu Marriage Act.
