What does the law say about issuing challan?

Under the Motor Vehicle Act, traffic rules apply equally to all drivers, whether male or female. There is no such provision anywhere in these rules, which prevents a male policeman from stopping a female driver or issuing a challan. Similarly, the Supreme Court of India has also not issued any such order, which states that a male police officer cannot take traffic action against a female driver, that is, the traffic change is completely gender neutral. At the same time, police can stop any vehicle on the basis of document check or rule violation. Stopping a vehicle, checking documents or issuing a challan does not fall in the category of arrest. This is part of normal traffic duty. In the traffic department, officers of Assistant Sub Editor rank or above can ask for driving license and vehicle documents and can issue challan in case of violation of rules. This right is not linked to the gender of the driver.

Rule to stop female drivers at night

Most of the confusion regarding vehicles occurs regarding the rules related to arrest. Under the law, arrest of a woman after sunset should be done only in the presence of a female policeman, but this rule applies only to arrest or detention, not to routine traffic checks. In many states, keeping security and comfort in mind, efforts are made to deploy women policemen on night duty, but this is not a legal obligation.

Confusion cleared due to Navi Mumbai’s action

In 2015, Navi Mumbai Police had launched a strict campaign against those breaking traffic rules. Challans of many women drivers who violated rules on Golf Club Road were issued by male policemen only because there were less women constables. The police had clarified that the law does not differentiate between men and women.

Female drivers should know these rights

  • While driving on the road, female drivers should know that it is necessary to cooperate during legitimate traffic checking.
  • Apart from this, under Section 160 of the Code of Criminal Procedure, the woman cannot be called to the police station alone.
  • At the same time, arrest cannot be made at night without the presence of a female policeman.
  • In case of any kind of misbehavior, the woman driver can lodge a complaint on the complaint portal 112 or the concerned state police.
