With the beginning of the second phase of the budget session of Parliament, a big political conflict can be seen in the Lok Sabha. On Monday, a proposal to remove Lok Sabha Speaker Om Birla from the post will be brought in the House. Regarding this proposal, both the ruling party and the opposition have issued whips to their MPs to remain present in the House.

This notice was given by the opposition parties during the first phase of the budget session. During the discussion on this proposal, Om Birla will not preside over the proceedings of the House and will sit among the MPs.
Speaker will not preside over the proceedings during discussion
According to the provisions of the Constitution, when a motion for removal from the post of Speaker of the Lok Sabha comes in the House, then he cannot preside over the House. During this time they can sit in the front row of the ruling party and also have the right to defend themselves against the proposal.
Opposition’s allegation- discrimination in discussion
The opposition parties have alleged in their notice that during the discussion of the motion of thanks on the President’s address, Leader of Opposition Rahul Gandhi and other opposition leaders were not given adequate opportunity to speak. The opposition says the Speaker indulged in ‘blatant discrimination’ during the proceedings.
118 opposition MPs gave notice
According to sources, at least 118 opposition MPs had given notice of the proposal to remove Om Birla from the post. This notice was submitted by Congress MP and party Chief Whip K Suresh to the Lok Sabha Secretariat on behalf of several opposition parties including Congress, Samajwadi Party and DMK. However, TMK MPs did not sign this notice.
Birla had stopped the presidency on moral grounds
According to sources, Om Birla had stopped presiding over the House from the day this notice was given. Although, as per the rules, he could have presided over the proceedings until the notice was presented, he decided not to do so on ethical grounds.

According to constitutional expert PDT Acharya, the Speaker has the right to express his views and vote on the proposal. However, they will not be able to use the automated voting system and will have to fill a separate slip to cast their vote.
Speaker can be removed by simple majority
According to the Indian Constitution, the Speaker of the Lok Sabha can be removed from the post through a resolution passed by a simple majority in the House. There are provisions for this in Article 94 and Article 96 of the Constitution. The majority is calculated on the basis of the effective number of members of the House, and not just on the basis of the members present and voting.
What is the proposal process?
According to the rules, signatures of at least two MPs are required to bring a proposal to remove the Speaker, although more members can also sign it. The notice is given to the Lok Sabha General Secretary. After this, a preliminary investigation is done to see whether there are clear and specific allegations in it or not. After completion of the investigation, the proposal can be brought in the House after 14 days.
Such proposals have come in the past also
In the history of the Lok Sabha, such motions have been brought against the Speaker before, but till now no motion has been passed. In the past, Lok Sabha Speakers like GV Mavalankar, Hukum Singh and Balram Jakhar also had to face no-confidence motions, although these motions were rejected.
