Consumer Court Verdict: In Aligarh, a shopkeeper selling cigarettes at a price higher than MRP and the famous cigarette manufacturing company ITC have both been fined heavily. The consumer court has taken strict action in this case and ordered compensation worth lakhs of rupees. This decision of the Consumer Court has created a stir among the shopkeepers not only in Aligarh but in the entire state.
On January 29, a customer had purchased a packet of ‘Classic’ brand cigarettes from the shopkeeper. However, he was charged Rs 20 more than the MRP printed on that cigarette packet. Even when he protested, the shopkeeper charged him Rs 360, i.e. Rs 20 more. After this the customer collected the evidence and filed a complaint in the court.
What is the court’s decision?
During the hearing of the case, the District Consumer Commission heard the arguments of both the parties in detail. Its commission bench chairman Hasnain Qureshi and member Purnima Singh Rajput upheld the complaint. Considering the shopkeeper guilty, the Commission has imposed a heavy fine of about Rs 10 lakh on both the opposition parties under Section 39(1)(k) of the Consumer Protection Act 2019.

It was also ordered that Rs 20 recovered from the consumer should be returned with 18% annual interest and a compensation of Rs 5,000 should also be given for mental harassment.
