Ajaz khan case: The Mumbai court has refused to grant anticipatory bail to actor Ejaz Khan in a rape case. Additional Sessions Judge (Dindoshi Adalat) Dutta Dhobale refused to give relief to Khan on Thursday, saying, “In view of the nature and seriousness of the allegations, the petitioner is required to be interrogated in custody”.
The prosecution alleged that he allegedly misused his position as a celebrity and reality show presenter to win the victim’s confidence. The victim herself is also an actress.
What are the allegations against Ejaz Khan?
The FIR alleges that on the false excuse of marriage, financial help and professional help, Khan on several occasions with the victim to have “physical relations” without her clear consent.
A case has been registered under the sections of the Indian Code of Justice for Rape and deception on Khan.
Ejaz Khan’s lawyer gave this argument
Emphasizing for anticipatory bail, Khan’s lawyer argued that his client has been falsely implicated in the case.
He said, “The victim was well aware of this, the actor is already married. Both are adults. The relationship between her and the victim was made by consensus. ”
The defense presented some WhatsApp chat and audio recording before the court, which reportedly shows that the victim had demanded money to withdraw the case and had physical relations with consent.
On the other hand, the prosecution argued that the interrogation of Khan in custody was required for the recovery of his mobile phone, WhatsApp chat and call recording.
What did the court say?
After hearing the arguments of both sides, the court said that the FIR revealed specific dates, places and circumstances of the incident, in which the petitioner has allegedly assured financial assistance to her family, including professional help not only by the petitioner but also to the victim.
The court said that interrogation in Khan’s custody was necessary for his medical examination and “collecting other digital evidence”.
The court dismissed Khan’s plea, saying, “If bail is granted before the arrest, the evidence cannot be denied the risk of tampering or affecting witnesses.”
