Judges Summer Vacation: Chief Justice Bhushan Ramakrishna Gavai (CJI Br Gavai) said during a case a few days ago that a large number of judges are maligned to pending the cases, while lawyers do not actually want to work. His remarks were discussed on Monday (May 26, 2025). Two senior advocates repeated CJI’s remarks in court and said that this was said about us, so we have come to court.
Every year from the last week of May to the first week of July, the Supreme Court judges stay on summer vacation. Last week, a case came before the bench of CJI BR Gawai, in which the lawyer requested that the case be listed for hearing after the Supreme Court vacation. On this appeal, the CJI was enraged and he said that if the bench would sit for the first five days of vacation, then why should the date after vacation need. Then he also said that lawyers do not want to work and judges are maligned for case pendency.
Referring to this comment by CJI Gawai, senior advocates Mukul Rohatgi and Siddharth Dave expressed displeasure according to the report of the Bar and Bench. He put this in front of the bench of Justice Vikram Nath and Justice Suryakant. Mukul Rohatgi reached the court to hear another case. When he came in front of Justice Vikram Nath and Justice Suryakant’s bench, he asked Rohatgi, ‘What are you doing here in vacation?’ Rohatgi told the bench that CJI Gavai has said that the bench will sit for the first five days for hearing, so everyone has to come to court. This will be partially working week.
Second lawyer Siddharth Dave also expressed displeasure referring to CJI Gawai’s remarks and said that we were condemned and so we have come to court. Justice Vikram Nath said in a funny manner, ‘You go to the CJI court. He is the master of the roster, but I am the master of my court. Everyone started laughing loudly at this matter of the judge.
Justice Vikram Nath said that the old practice of not attending senior advocate in vacation should be resumed in the court. Justice Suryakant said that yes it is needed. After listening to the bench, both advocates said, ‘Milord, we will be happy if this happens.’ All the people present in the courtroom laughed out loud on the comments of the judges.
