Supreme Court: During the hearing of the case related to the disqualification of Telangana Dalabalu leaders, the Supreme Court also taunted the leaders of Maharashtra on Tuesday (March 25). The court pointed to the political upset in Maharashtra in the last few years and said that in ‘Aya Ram, Gaya Ram’, Maharashtra overtook all other states.
The bench of Justice Bhushan R Gawai and AG Christ was hearing a case related to the disqualification of three MLAs of Bharat Rashtra Samithi (BRS) joining Congress in Telangana. During the hearing, the bench said that the 10th schedule of the Constitution, which is aimed at stopping the political defects, is becoming meaningless as no action is being taken on petitions seeking disqualification of party -changing MLAs.
The bench said that ‘Aaya Ram Gaya Ram’ started from the kingdom of Mere Bhai (Punjab and Haryana) but in recent years, Maharashtra overtook all the states in this matter. The bench also said that the purpose of the 10th schedule is to stop ‘Aaya Ram, Gaya Ram’. If the courts do not interfere in these cases, then it will be a joke of the 10th Schedule.
Where did ‘Aya Ram Gaya Ram’ idiom
‘Aya Ram, Gaya Ram’ is a popular idiom in Indian political. This MLA from Haryana is built on Gaya Lal. Gaya Lal changed the party thrice in the same day in 1967. In the following years, the state governments continued to fall due to the defection of many MLAs. This is the reason that Parliament had to enact a law to stop this tradition. In 1985, the Constitution was amended and the 10th schedule was added to disqualify MLAs and MPs on the basis of defection. This is usually known as anti -defection law.
Which case was hearing?
Three BRS MLAs from Telangana, Telm Venkat Rao, Kadriya Srihari and Danam Nagendra joined the Congress. One of them even contested the Lok Sabha elections on a Congress ticket while being a BRS MLA. The petition filed to disqualify these three MLAs and hold the assembly elections again in their seats was going on.
