‘One man pulling the other inhuman’, Supreme Court ordered the hand rickshaw in Matheran, Maharashtra to immediately shut down

The Supreme Court has ordered the immediate closure of the hand rickshaw running in Matheran, the hill station of Maharashtra. Describing it as inhuman, the court asked the state government to make a policy to provide e-rickshaws to those who run hand rickshaws. He should consider adopting an e-rickshaw system like Kevadia in Gujarat.

India’s Chief Justice BR Gawai wrote an order on behalf of a three -judge bench, saying, “No person draws the other by his own will. He does this because he has no other means of living, but such a trend is against human dignity. It will be a matter of downs to degrade the constitutional promise of social and economic justice.”

Supreme Court mentioned a historic decision of 1980

The court in its order has mentioned the 1980 historic ‘Azad Rickshaw Polers Association vs Punjab’ verdict. In that decision, many instructions were given to give dignified lives to the rickshaws. The Chief Justice said, “It is unfortunate to continue the hand rickshaw even after 78 years of independence, 75 years of the constitution and 45 years after this historic decision.”

It has been said in the order that the state government will have to formulate a policy to provide e-rickshaws to the people. She cannot avoid it by making an excuse for lack of funds. The court has given this order in a case related to environment and forest conservation.

The Supreme Court had instructed the state government to form an e-rickshaw policy in February

In fact, due to Matheran being an environmentally sensitive area, there is a ban on running petrol and diesel vehicles there. In such a situation, there is a means of rickshaw traffic for tourists and local people there. In view of the previous orders of the Supreme Court, some e-rickshaws have been made available there. In February this year, the Supreme Court asked the Maharashtra government to form an e-rickshaw policy in 6 months. Now the court has immediately stopped the hand rickshaw.
