The Delhi High Court quashed the order of the Central Information Commission (CIC) to disclose information related to Prime Minister Narendra Modi’s graduation degree. Delhi University challenged the order of the Central Information Commission. On the basis of an RTI petition filed in 2016, CIC was instructed to disclose information related to PM Modi’s graduation degree.
‘Not mandatory to disclose educational record and degree’
According to the order of Delhi High Court Judge Sachin Dutta, it is not mandatory to disclose educational record and degree. This legal battle has been going on for years regarding the revelations of PM Modi’s academic record. After filing the application under Right to Information (RTI), the Central Information Commission gave permission on December 21, 2016 to inspect the records of all the students who passed the BA examination in 1978. PM Modi also passed this exam.
CIC had ordered to make the degree public
The university rejected it, citing rules of not sharing information related to third party. However, the Chief Information Commission (CIC) did not accept this argument and ordered DU to allow inspection in December 2016. The CIC said that any public person, especially the educational qualifications of the Prime Minister, should be transparent. The CIC also said that the register with this information will be considered a public document.
Against this order, the university had approached the High Court, where it was represented by India’s Solicitor General Tushar Mehta and his legal team. Tushar Mehta argued that issuing data would lead to a dangerous example, which can cause obstruction in the functioning of government officials. He said that some people are advocating to release records inspired by political objectives.
