After hearing the petition of Arvind Kejriwal and others in the excise policy matter, Delhi High Court reserved its decision. In the petition, a demand has been made to recuse Justice Swarn Kanta Sharma from hearing the CBI’s petition against the decision of the lower court in this case. On Monday (April 13), Arvind Kejriwal himself gave his argument in the court.

‘Recusal petition should be rejected strictly’
SG Tushar Mehta said that Arvind Kejriwal’s recusal petition should be strictly rejected. Other benches have also considered this and have reached the same conclusion. SG said that we can win, we can lose but we have to be fair towards the court.
Judge asked Arvind Kejriwal a question, ‘What do you want to say that I am politically biased’
SG Tushar Mehta said that it is very easy to say that the case should be sent to some other judge, but the precedent that will be set by this should also be kept in mind. This will create a precedent that on the basis of mere speculation and almost defaming the judge, a litigant can choose the bench of his choice. The question is not whether the honorable judge can hear this case or not, but rather, if the judges start recusing themselves on this basis, will any judge be able to hear these cases?

Arvind Kejriwal said in his argument that there is an old tradition that if the close relatives of the judge are associated with the political party/ruling party, then the judge recuses himself from the hearing.
