Many popular drinks available in the market, which companies are selling in the name of Energy Drink, are now being questioned. Food safety regulator FSSAI has issued notices to many big brands including Red Bull, Sting, Monster, Campa Energy, Hell Energy, Adrenaline Rush and Gold Boost. It is alleged that companies are misleading customers through branding and claims of their products.
After all, what is FSSAI’s objection to?
FSSAI says that till now no official food category named Energy Drink or any separate standard for it has been decided in India. This means that selling a product just by calling it Energy Drink or promoting it under that name cannot be considered as per the rules. The regulator says the food category system is only for administrative classification. It cannot be used as a product name or marketing term.
Which brands received notice?
Brands receiving notice include Red Bull, Sting, Monster Energy, Campa Energy, Adrenaline Rush, Hell Energy and Gold Boost. FSSAI says that Energy Drink is written on the packaging of these products. In some cases, they are also being promoted under the same name on e-commerce platforms.
Not just the name, questions on the claims too
FSSAI has not only objected to the term Energy Drink, but has also raised questions on the claims that this drink increases energy. Improves focus or removes weakness. The regulator says that such functional or therapeutic claims for food products are not acceptable under the rules, unless there is regulatory permission for them.
What does this mean to you?
This notice does not mean that the sale of these products has been banned. At present FSSAI has sought answers from the companies and has given instructions to do the labeling and marketing as per the rules. At present the question is on under what name and with what claims the companies are selling their products and not on the fact that these products cannot be sold in the market.
What will happen next now?
Now everyone’s eyes will be on the response of the companies. If FSSAI does not find the companies’ response satisfactory, further regulatory action may be taken. At present, no official response has come from the companies in this matter.
