Non-bailable warrant has been issued against Lashkar-e-Taiba Chief Hafiz Saeed in the Pahalgam terrorist attack. The trial of the case has started in his absence and the NIA has prepared a supplementary chart sheet against him and made him an accused. In the charge sheet, Hafiz has been described as the mastermind in the Pahalgam attack. The process of declaring him a fugitive will also begin. Non-bailable warrant issued against Hafiz Saeed
A major legal step has been taken in the investigation of Pahalgam terrorist attack in Jammu and Kashmir. A Jammu court has issued a non-bailable warrant against Pakistan-based Lashkar-e-Taiba leader and 26/11 Mumbai attack mastermind Hafiz Saeed. It is believed that after this order, the way has been cleared for ‘trial in absentia’ (trial in the absence of the accused) against Hafiz Saeed in India.

In the petition filed in the court by NIA, it was said that Hafiz Saeed is present in Pakistan and it is not possible to bring him to India at present. In such a situation, the process of prosecuting him in absentia should be initiated under the law. Agreeing with the arguments of the NIA, the court issued a non-bailable warrant.

What is ‘trial in absence’
The Government of India has recently made such a provision under the new criminal laws, according to which if an accused is absconding from India, is deliberately not appearing before the court and there is sufficient evidence of serious crimes against him, then the case can be prosecuted even in his absence. First the court issues summons and warrant to ensure the presence of the accused. If even after this the accused does not appear, he can be declared a fugitive and then the court can start hearing the case in his absence.

According to NIA, Hafiz Saeed has been the main conspirator of many major terrorist attacks against India. The investigating agency says that the conspiracy of Pahalgam attack was also hatched in Pakistan and Hafiz Saeed played an important role in it. NIA told the court that all legal possibilities to bring him from Pakistan to India are almost over.

Therefore, it is necessary to prosecute him under the new law, so that the judicial process can proceed. In its first charge sheet, NIA had named three Pakistani terrorists Suleman, Jibran and Hamza Afghani as accused. Apart from this, Pakistan-based terrorist Sajid Saifullah Jatt of Lashkar Tayyaba and Bashir Hai Ahmed and Parvez Ahmed, residents of Pahalgam, were also accused.
