Recently, Chandigarh District Consumer Disputes Redressal Commission, while hearing a complaint related to running shoes, has ordered sports footwear company ASICS India to pay additional compensation of Rs 10,000, blaming it for deficiency in service and unfair trade practices.

A customer named Ajay Malik purchased a shoe of an expensive brand, but within just a month he started feeling problems while running and walking. During investigation, they came to know that the sole of the shoes had separated from the heel and sides, due to which they were facing a lot of difficulty in using them. After this, Ajay Malik reached the store with the shoes, where his claim was initially accepted.

But since the same model was not available with him, he was asked to choose other shoes and was also made to sign the exchange form. However, later the company flatly refused to replace the shoes or return the money and only asked to give credit vouchers. On the other hand, the company defended itself in front of the court and said that there was no defect in the shoes.

Why did the Commission give its decision in favor of the customer?

After listening to everything, the court said that if there was no defect in your shoes then why did the company accept the claim and get the exchange form signed. Apart from this, he said that when a customer spends a good amount of money for an expensive brand, he expects good quality. In such a situation, the shoes getting spoiled in just one month shows the carelessness of the company.

What is the final decision of the court?

The court ordered the company to refund the full purchase price of Rs 6,499 of the shoes to the customer. Apart from this, 6% annual interest will also be paid from the date of purchase. Also, in view of the mental distress and expenses incurred in legal action, the court has ordered to pay additional compensation of Rs 10,000 to the customer. After this he said that the company will have to pay this entire amount to the customer within 60 days.
