A big decision has come in America regarding citizenship by birth. The US Supreme Court has upheld the principle of citizenship based on birth. After this decision, President Donald Trump said that this is not a good thing for America, but he expressed confidence that this system can be changed by bringing a law in Congress.

What was Trump’s order?

This case was related to the executive order which Trump signed on the first day of his second term. The purpose of this order was to prevent giving American citizenship to those children whose parents are living in America illegally or are present on a temporary visa. The Supreme Court, while giving its verdict by a majority of 6-3, said that almost all children born on American soil will get the right to citizenship. Earlier, lower courts had also stayed Trump’s order.

What did Chief Justice John Roberts say?

Chief Justice John Roberts, writing the majority decision, said that American-born children whose parents are in the country illegally or temporarily are subject to American law and become citizens at birth under the 14th Amendment of the Constitution. The decision of the Supreme Court also said that an amendment to the Constitution may be required to change the system of citizenship by birth. Citing the 14th Amendment, the court said that with very limited exceptions, every person born in America is a citizen.

Justice Department statement

The US Justice Department said it would continue to pursue illegal “birth tourism” schemes. The department said that people trying to obtain automatic citizenship for children by misusing the law are a threat to national security and action will be taken against them. This order ending citizenship by birth was part of the Trump administration’s broader immigration crackdown. This was included in the major policies of Trump’s second term which reached the Supreme Court for the final decision.
