Property grabbed 24 years ago, investigation was to be done in 42 days, not till now…SC got angry after seeing so much carelessness, read what it said.

The Supreme Court has expressed displeasure over the delay in a case that is more than 20 years old. The case in which investigation and report was to be given within 60 days and six weeks, has not been investigated yet. Now the court directed the Gujarat Police to complete the investigation of this case related to forgery and fraud in revenue records within six weeks. The court said that it is the duty of the constitutional courts not to remain silent spectators when the issue of long pending investigation is brought to their notice.

This case was heard before the bench of Justice Sanjay Karol and Justice Augustine George Masih. The bench said that the right to speedy trial is inherently linked to Article 21 of the Constitution. In this case, the complainant alleges that while he was on Haj, four people prepared fake documents of his property, on which his signatures were forged.

The man had filed a complaint before the Judicial Magistrate of Bhiloda against four persons under sections 120B (criminal conspiracy), 406 (criminal breach of trust), 420 (cheating) and 463 (making fake documents) of the Indian Penal Code.

It was alleged in the complaint that he had acquired this property himself in 1975. Later, when he was on Haj pilgrimage from February 5, 2002 to March 21, 2002, the accused forged his signature and prepared a fake partition deed and a fake sale deed related to the property. Through such forgery, the names of the accused were recorded in the revenue records.

In 2014, the police submitted a report before the Judicial Magistrate which was rejected and a detailed investigation was ordered. This investigation was to be completed within 60 days. Then in 2017, Gujarat High Court directed to prepare the investigation report within six weeks and also recorded that some material collected during the investigation had gone missing from the concerned police station. The Supreme Court said in its decision that the High Court should have taken note of the excessive delay in filing the charge sheet and should have intervened in this matter.
