Real Estate News: A couple, who were victims of fraud by a builder in Mumbai, had been searching for justice for the last 10 years. Who has now got justice after a decade. The case was from Mumbai where a couple had bought a flat through a builder. Even after paying the full price of the flat, the builder had given the flat to someone else. After which the couple approached the court, from where the couple has now got justice and the entire amount of the flat along with interest has been refunded.
What is the whole matter?
Actually, Mohammad Jalil Harnekar and his wife Asghar Shabnam had booked a 660 square feet flat in Mumbai in 2013. Earlier he had invested in a project in Dongri, but after the project got stalled, the builder shifted his booking to the ‘Bay View’ project in Mazgaon and fixed the price of the flat at Rs 90 lakh. The couple paid the entire amount by 2018, but neither did they get possession of the flat nor was the sale agreement registered.

builder’s cunning
Later it came to light that the builder had played a trick and the same flat had been sold to another buyer. After which the couple talked to the builder and asked for their money back, then the builder gave a check of Rs 1.25 crore, but there was not enough money in the account due to which the checks bounced. After which the couple approached the Commission seeking help.
Commission’s decision
After the complaint was received, after knowing the whole matter, the Commission also considered it as serious negligence and unfair business practice. After which the Commission has ordered the builder to return Rs 1.05 crore with 10% annual interest, Rs 50,000 for mental agony and Rs 25,000 as litigation expenses. If payment is not made within 60 days, the interest rate will be increased to 15%.
This decision of the Commission has brought a lot of relief to the victim couple. This matter was pending for the last 10 years. After which the couple has now got a sigh of relief.
