Why should the reservation limited to government institutions only? The same question has now been raised by the Standing Committee on Education of Parliament. The committee headed by Digvijay Singh presented its report in Parliament and clearly stated that reservation should be necessary for Scheduled Castes (SC), Scheduled Tribes (ST) and Other Backward Classes (OBC) students in private higher education institutions.

The committee has suggested that Parliament enacts a law under which 15% reservation for SC students in private colleges and universities, 7.5% for ST students and 27% for OBC students can be ensured.

There is a provision in the constitution, but not implemented

The report made it clear that Article 15 (5) of the Constitution, which was linked to the 93rd amendment by the Manmohan Singh government in 2006, gives the government the right to make reservation in private higher education institutions. In 2014, Article 15 (5) was also valid by the Supreme Court in Pramuti Educational and Cultural Trust vs. India case. That is, the way to implement reservation in private institutions is already open. Despite this, Parliament has not yet passed any such law that will force the private higher education institution to give reservation for SC, ST and OBC students.

Very low representation in private institutions

The committee said in its report that the representation of marginalized communities in the top private colleges and universities of the country is very low. According to the data, the number of SC students is less than 1%. The presence of ST students is around half percent. At the same time, the share of OBC students is limited to about 11%.

What do experts say?

Experts say that today Private Higher Education Institutes are ahead in terms of research, technology and international cooperation. Students get better opportunities from studying here. But students of social and economically backward classes do not reach these institutions. The big reason for this is the lack of more fees and reservation. If reservation is implemented in private institutions, then SC, ST and OBC students will not only get admission but will also get equal opportunities.
