Mahindra Case: There is a lot of excitement when buying even the smallest new thing for the family. Especially while buying a car or a house, the level of excitement is different. But imagine, how would you feel if your booked vehicle is not delivered to your home even after full payment?
Something similar happened with a person from Puducherry, who had booked XUV500 from Mahindra & Mahindra with great expectations. Not only had it been booked but the full payment had also been made. But this vehicle never reached his house. After which, being disappointed, the person lodged a complaint in the consumer forum.

What is the whole matter?
Actually, this case is of the year 2013, the customer first gave advance of Rs 40,000 to buy Mahindra XUV500 W6. After this, he took a loan of Rs 8.96 lakh from the bank and deposited the entire amount in the dealer’s account. The dealer had assured that the car would be delivered within a week. But after a week the customer was told that the car was not available and the delivery would be delayed by a month. Even after asking several times, he was given only evasive words and the car was never given.
What does the commission say?
After this the customer lodged a complaint in the Consumer Forum, after this complaint the Commission, after knowing the entire matter and listening to both the parties, accepted that this was a gross negligence on the part of the dealer. At the same time, the company also could not ensure the delivery of the car, hence both are responsible. After which the Commission ordered that Mahindra & Mahindra should return Rs 8.71 lakh to the customer with 12% annual interest. The dealer should pay compensation of Rs 1.5 lakh for mental anguish, lack of service and other problems.
Not only this, the company should also give an additional compensation of Rs 50 thousand. Also, the dealer should pay Rs 10,000 towards the expenses of the case. This decision of the Consumer Forum will provide relief to the customer from both financial and mental troubles he has faced.
