The seniority of judges in the Supreme Court is decided from the date of their appointment. That means, the judges who were appointed first are considered senior. If two judges are appointed on the same day, their seniority is decided by looking at the date of their service as judges in the High Court. Next comes the most senior judge and at the end is the most junior judge, who has been appointed recently. With time, when the old judges retire, the seniority of the remaining judges increases.
What is the role of CJI?
CJI is not only the head of the Supreme Court, but is also considered the head of the entire judicial system. They decide which case will go to which bench, which judges will be given hearing of which cases and many administrative decisions are also in their hands.
How is the hierarchy?
According to reports, the Supreme Court is at the top. After this comes the High Court. Then there are all the subordinate courts. After all these come the District Court, Civil and Sessions Court (Criminal). If we talk about District Court Civil, then there are District Judge, Additional or Assistant Judge and then Civil Judge. Supreme Court judges are appointed under the collegium system. In this, the CJI and four senior judges together decide who should be appointed to the Supreme Court. The President approves this recommendation and only then the appointment is made.
When does the judge retire?
Supreme Court judges retire at the age of 65. Even after retirement, many judges serve in commissions or tribunals.
